Her initial overdrawn amount was approx £10 but she didnt realise and then got letter after letter, so with poor wages etc she never caught up.
We managed to sort this out but we had to pay in enough to cover it and we then closed the account.
Are we still able to attempt to claim these back or because the account is shut (due to the charges) are we prevented from doing this.
This all dates back to about 1999/2000 and amounts to approx £300.
Thanks for looking, all advice welcome

You can claim your money back, yes. In fact, you're in an even better position, as they can't threaten you with pulling in your o/d, or closing you down!
Good luck.0 -

Yeah, you'd think...0 -

You're looking for unauthorised overdraft fees, unpaid direct debit fees, paid referral fees, that kind of things.
You can not reclaim ATM fees, or legitimate o/d fees (recognisable by the fact they are much, MUCH lower).
In theory, you can also reclaim the interest levied on the charges or higher unauthorised borrowing interest, but the calculations are complicated and there is an argument that the banks should be allowed to recoup their alleged costs, so I tend to advise to leave that well alone.
According to the latest survey results on consumeractiongroup.co.uk, £22654 have been recovered from LTSB by 26 people. These figures are incorrect as far as we know that only about 1/4 people fill in the survey once they have their money, either because they agree to confidentiality or because they can't be bothered.0 -

At last Halifax have come back to me with regards the unfair bank charges they are imposing on my account...BUT...they have only offered me £238 opposed to the £1,029.72 that they owe me. Help! Obviously I don't want to accept this offer as I want the full amount. Is there a template letter I can use to go back to Halifax requesting the full amount again?
Thanks
I suggest the Letter before Action in the library of the ConsumerActionGroup. Then tweak it to say that you'll accept the £238, but that only full repayment will stop you from proceeding with court claim within 14 days.
You say "at last", it suggests they are not sticking to your timetable. It's your claim, your deadlines, Don't let them dictate the pace. You set them a deadline, and stick to it, if they haven't refunded in full in 14 days from your letter, sue. They'll soon react then!0 -
You can only claim back with 6 year's worth.
1999 is a no but you can for 2000.nelly05 wrote:When i met my partner, she had got herself into a little bit of debt, which was increased fivefold by the charges levied on her.

Got charged £30 by Barclays for being £6.03 overdrawn for a few hours. By calling their call centre and mentioning your article, The Bank Action Group and the OFT I got an instant refund credited to my account. Many thanx for the great advice :T0

I transferred from Yorkshire bank to Norwich & Peterborough Building Society last year in an effort to save interest and default charges.
Yorkshire Bank made many charges to my account over the 20 -odd years I was with them and I wish I knew then what I know now about reclaiming charges.
I am going to contact Yorkshire Bank asking them for the charges applied in the last six years. Will they still have this information as my account has been closed?

It only took 8 e-messages within 5 days with HSBC's internet banking. Then, they credited back 2 unfair overdraft charges with total value of £100!
I was only over my overdraft limit by a few p's and they charged me £000's !
To all who are in a similar situation - push it hard, tell them that you will be changing banks and take it up to "Complaints" if needed. It Pays off ! It certainly paid for me !!0 -

Yes, by law, they have to keep your info for a minimum of 6 yrs. Make sure you make your request under the DPA, this way, they can charge you a maximum of £10 for it.0 -
