Hi Lizanne and welcome. There'll be others with more advice along soon, but i just wanted to let you know that I've just written my letter to Abbey and the account is with a DCA.
The DCA have told me to only deal with them, but I'm not listening to this, as they haven't got the right to pay the money back to me.
Best of luck with whatever you decide to do. Keep strong where the DCAs are concerned. Read all you can from this site, and now your onions so that when they ring you can feel in control and get what you want.DMP mutual support number 174Total debt now (April 10) £0! - total paid off £30,221 or 100%I'm now debt free after 6 years!!:jNon smoker since June 2006 :j0 -
Hiya
I am wondering if anyone can help. Sorry this story might get complicated but please bear with me as I have had enough and am making a stand!
We bank with the Abbey (aka Scabby in our house as we hate them so much but that is another story).
When I got this months statement in I noticed I was being charged £80 for going £13 overdrawn on the 2nd Oct
£20 for going over od limit By £1.49,
£30 for paying a DD of £10 that took me over my od limit by the above amount,
and a further £30 for another £10 DD taking me £11.49 over
and then £1.88 for interest charged while account overdrawn taking me to £13.49 od.
I phoned the bank and claimed that £80 was a ridiculous amount and would like the charges dropped. Now here is the rub due to no fault of our own and a business that we had used to fix our pram £499 was taken from our acc last month by "mistake" (banks and business' word not mine I would have said stolen). After a lot of toing and froing by my hubby (joint acc) all our charges were refunded, we are now getting this thrown in our face and told well you had £140 charges refunded last month so we can't refund any more! We got told a note would be put on our acc with words to this effect. After being passed about and having to explain the mistake/stolen money every time I was offered a refund of £30 which I declined as £50 is still way too much.I did offer to pay £20 as I do accept that we went over od but nothing was ever mentioned about it when I was passed around, have I shot myself in the foot? I then got passed on to their complaints dept who today have sent me a letter saying that all they are offering is the £30 refund and if I don't reply in 8wks time they will assume everything is resolved and will close the file.
Another thing that happened this month is that I wasn't paid. I am currently on mat leave after having two gorgeous girls in March. I had forgotten to send back my return to work form resulting in no wages being paid in Sept. If I had returned the form I would have been paid(currently signed off as I am absolutely shattered running around after 3 under 3) and we wouldn't be in this mess.Got my wages sorted and once all Childminders and other bills were paid, deposited the rest of my wages on the 4th. Have also explained this to the bank.
I am currently on the process of shutting down and paying off the od on that account and going elsewhere.
I think that is everything, so if you have got to the bottom of this post, thanks.
Where do I go from here?
Is there a copy of a letter I can write on here?
If I shut down the acc before the charges take place (3rd Nov) will they chase me or give up?
All help gratefully received.

anyone got any ideas on what I should say in my refusal letter? The message you have entered is too short. Please lengthen your message to at least 10 characters.

Hi
Just to say that I have filed online with Moneyclaim to help SIL get all her charges etc back. This amounts to nearly £2500 including the 8% so far....so do they now have 14 days to reply?
Thanks again for all the help.

Response to settlement offer.
Dear Sir/Madam
Thank you for your letter dated xxxxx
I respectfully decline your offer of settlement and request, once again, that you return to me all charges imposed on this account, totalling £2317.12
I will accept the sum offered only as part settlement and on the clear understanding that I will pursue recovery of the remainder, with a County Court claim if necessary.
My letter before action sent previously indicates that you have until 23/10/2006 to respond before Court action commences. You are reminded that there will be no extension to this timescale.
I trust this clarifies my position.
Yours faithfully

Liza, Have a read of Martin's article and start proceedings to claim back all previous bank charges including the ones you are currently being asked for.
Have a look at and sign up for the CAG forums and Penaltycharges and send off the standard letters, templates of which you'll find on CAG or Penalty Charges.
One tip and please don't take offense at this, just use the standard letters and don't go into details about the whys or wherefores0 -

It is an online claim service! best to log in every day to keep abreast of what is happening. Is it over 28 days since they were served the claim? If so you must proceed to the next stage and request a judgement. If you leave it you are just giving them more time to defend the case.Littlewoods catalogue - won back charges of £300 by default.

Tried getting back a £20 charge by the Halifax for paying late, as they say, by one day. Sent payment on 16th of May & credited to my account on 27th May but it cleared my bank on 20th May. They refuse to answer any letters sent - even two by recorded delivery. Customer services operators rude and unfriendly. Would move if I could find a cheaper APR but all I have tried cannot help.
Mentioned Martin's web pages on subject but failed to impress them.

What is the daily rate of interest from when the claim is submitted and did you use any particular wording in the particulars of claim or did you just list the details of the charges (date and how much).
Hope you can help and thanks for your assistance
The particulars of claim process is laid out here, http://forums.moneysavingexpert.com/showthread.html?t=158155, and the spreadsheet you need to use to calculate the interest is here, http://www.consumeractiongroup.co.uk/forum/bank-templates-library/182-6-interest-calculation-spreadsheets.html. If you like drop me a private message and I can copy my particulars of claim to you for you to adjust. In answer to your questions, the interest is 0.022% a day from the day the charge was levied against you to the day you submit your claim (the spreadsheet will work that out for you), and then on the whole amount from the day the claim started to the day that judgement is requested. You must make sure you add in the bit about interest if you want to claim this!Littlewoods catalogue - won back charges of £300 by default.
