  • I have a bussiness account and a persoal account and notice if the bank refuse a DD for my bussiness account even for 6 pounds they still charge me 35 pounds the same day. Surey if i can,t afford 6 pounds how can l pay nearly six ties that amount. Also i have had to phone the bank on many occasions about charges that they had got wrong. Wish i could charge the bank for my waste of time. My bank account online for busness shows you yesterdays balance it takes out money going out by balance available but does not add money coming in is this agaist the law.
    any advice on this matter would be great
  • can I claim back after moving bank? We're fed up of barclays so am going to abbey tomorrow and switching over, but barclays took £400 off me, can I still claim it back off them if I close my account down?

    Hi all. I am just starting to get the ball rolling on claiming back my charges from HSBC.
    I have printed off the subject access request form and just about to send it off. My problem is, I have an overdraft(£800) and this morning I got a letter from the bank demanding I pay it off in 7 days. It was an authorised O/D but I have a business account with another bank and havent been putting alot of money through my HSBC account so they are trying to close it down. But to be fair after adding up the charges from the statements I do have already exceeds the amount I owe them. Dont know if I should clear the overdraft first which isnt something I can do straight away, before I start claiming things back. Im worried that if I do start claiming they will get funny with me and send it to collections, affecting my credit score instead of giving me a chance to make proposals and prolong any action. Like I say though they owe me more than I owe them. but worried I might shoot myself in the foot.
    Any info and advice would be greatly appreciated.

    If it were me I think I would try to clear the overdraft first then claim the charges back. If they owe you more than you owe them this shouldnt be a problem in the long run, but it altogether safer if you don't owe them anything before you try to take them to the cleaners. Remember it may take up to 2 months to get the money back, maybe longer if they decide to defend, and if they are asking for their overdraft back in 7 days, the two wont meet nicely in the middle, if you get me!

    If you no lonegre bank with them it makes it easier for you. Some banks can get funny and close your account and ask for any money owed back. You are in the best position to start your claim once you have moved banks IMHO! And remeber you can claim back up to 6 years.

The money is always there in my other account, and I do have a little fund stashed away in my savings account so I'm really unsure if I can claim this money back. Can anyone help?


    Yes of course you can claim these charges back, they are penalty charges for not having enough funds in your account, therefore claimable. Your other accounts have nothing to do with the charges on your current account. Check back the last 6 years and see if you have incurred anymore of these penalties over the last few years. If its in the low hundreds the banks tend to not defend due to the costs of the case going to court is more than the amount claimed. Do be aware though that you should have a contigency plan should the bank decide to get rid of you as a customer, as you seem to be quite heavily invloved with this bank. If the charges are less than the amount you would lose if you switched banks (lower interest etc) is it worth claiming back the charges? Good luck!

    right guys need more help! So after this previous letter i have now recieved another saying exactly the same thing. They say the need more time and will get back to me again in the next 7 days do i just be patient with them?? It is actually seven days today but i havent had chance to check my post yet so unsure if i have another letter.
