Hello,
I have made a claim useing the money claim website and HSBC have acknowledged my letter which now gives them 28 days to respond, has anyone been through this and am i likley to go to court or will they pay up the full 1600??????
help me im getting very scared now!!!!!

Most will acknowledge, few will defend. When did they get served with the papers? 28 days from then make sure you are on the computer ready to request judgement, don't give them a minute extra to get a defence in!!Littlewoods catalogue - won back charges of £300 by default.

If you haven't already done so, sign up to the CAG Forums and you'll find a board there marked Scottish Procedures. You need to find your local Sherrif Court and you then send them the letters that are linked to at CAG.0 -
Ive put my claim in and after a few weeks I recieived a letter saying 'As a gesture of goodwill I would like to ofer you a £130 (our charges for the last 5 years where £290) in full and final settlement of your complaint'
Now I have read on here something saying
'You will be offered a partial refund (refuse this - the money is legally yours - note we are not claiming for the extra interest incurred on overdrafts - this more than covers their costs, so don't start to feel sorry for them). You will receive a letter offering a full refund next.'
Now do I refuse or accept this?

I would refuse that offer, had it been nearer it might have been tempting but that is derisory so carry on with your full claim0

Just wanted to ask a question about the particulars of claim section. What is the daily rate of interest from when the claim is submitted and did you use any particular wording in the particulars of claim or did you just list the details of the charges (date and how much).

Hi,
I am new to the forum so pls be gentle with me.
A couple of years ago, I approached my bank to get a temp overdraft on my current account. They advised me that instead of this, they could give me a new account which had an O/D limit of £1000. Foolishly, I agreed.
The account went well for a start but then my husband was made redundant and we got into financial difficulty. They knew this but the charges still went on.
They have now transferred the account to a debt collection agency and we are now repaying this back at £100 a month, for the sake of £300 over the O/D limit. The balance that was tranferred was £1900, give or take a few pounds.
Can we still take on the bank, even though this is now in the hands of the collection agency.
By the way, the collection agency advised that if we could repay £1200, they would take this as settlement. We could not afford to do this and are now having to repay the whole lot.
Please help, as I am now on maternity leave and my pay has now gone down by £1000 a month, to which the collection agency is being very unsympathetic.0
