I got a letter back from my bank saying that they were willing to give me back £70 (I'm claiming for £318). I sent the letter back saying I want it all within 7 days or I'll start court action. The letter went out yesterday but I've just checked my account online and they've paid the £70 in without my knowledge. What do I do now?0

Did you send the standard letter saying you would accept it in part payment on the clear understanding etc etc ?
If so just hang on and wait for their response within the 7 days.0 -

No, I didn't state that in my letter as it was a letter refusing part payment. I sent it before I realised they'd already put the money into my account without my agreement.0 -

My turn for a couple of questions. How long should it take for a company to pay up once a judgement has been entered? And are people still claiming back the new £12 charges from credit cards (they have recently been reduced)?

Don't know if this has been covered already but here goes. After reading Martin's article I sent off the request for charges letter to Barclaycard with my £10 cheque (which they haven't cashed). They replied to my letter
along the lines of: "Barclaycard does not provide customers with lists of charges on request. Charges are only set out in statements. We have provided you with copies of statements that we can find since May 2004".
This is OK to a degree as I can look through them and identify what i want to claim. However my account with them stretches way further back than May 2004 and I know for a fact that there are more charges I can claim. However they say that their statements before this date aren't kept on their database and continue blagging something about being stored on microfiche and are not 'readily accessible' within the meaning of the Data Protection Act. Now I thought that all charges are available under the DPA regardles of what format they are stored in or how readily accessible they are.
Can someone confirm this and give me an idea of how to reply to them given that I have already sent a data request letter stating I want a list of charges which they say they don't supply. All I seem to have is a list of statements over the last two years from which I have to infer the charges.0 -
I've asked my previous bank, the Halifax, for details of my bank charges of the past six years. They sent me statements which simply state the amount and say 'Charges as notified', so I don't have any records of the reasons for the charges.
I've written to them twice asking for these details without response and have complained to the Information Commissioner under the Data Protection Act. I'm worried that each month I wait I'm losing out since I can only claim for the last six years.
Does anyone know if I have enough information to go to the small claims court or do I have to keep pursuing this information?

My bank account with Nat West was a business account and they say unfair charges do not apply to this type of account. Is this correct? I have already issued a summons, am I wasting my time and money.0

i have sent letter to natwest bank asking for all my statements since i joined them and notified them i would be reclaiming any unfair charges, today i have recieved a letter from them saying they will send the information to me and that any charges made to my account are in accordance with the terms and conditions of our current agreement with me as a result of the activity on my account. Does this mean, that because i have signed an agreement with them, that i have accepted the charges? if so, i don't understand legally how i have the right to reclaim the charges.0

When did they say this, have they replied to the summons offering this as their "defence" If you check out the CAG forums the wording for some letters are slightly different for business accounts, also check the board there for Nat West bank.0
