    Thanks shaun- what#s the best letter to use to issue a court claim against them? is it after 14 days of sending 2nd letter?
  • Hi everyone.

    Just thought i would keep everyone updated on my progress. It has been slow. after sending the initial letter detailing charges my bank simply ignored the letter. I sent yesterday the second letter(letter before action) to the HSBC. Hopefully they will now pay up but if they dont, then I will be continuing my quest.

    Will let you know how it goes.

    Hi everyone ... just to let you know how I'm getting on with my claim with Cahoot.

    I've done all the letter sending now, sent DPA, LBA and filed with MCOL.

    Cahoot have offered me half of my money but I want it all .. it is mine after all ;)

    Cahoot have filed a defence with Manchester County Court and I am sending in my completed Allocation Questionairre ... so something should be sorted out very soon,

    If it goes as far as me appearing in court then I will. I refuse to back down on this one.

    Anyway, I find the BEST site out there for invauable information, templates to send to the bank and on the spot advice is http://www.consumeractiongroup.co.uk/

    They now have a live chat room where you can ask questions if you need an instant answer (or even to chat about the weather).

    Don't be scared of trying to reclaim YOUR charges, go to the site, have a really good read around and you'll find that its not all a complicated as it seems,

    Just wanna share with you the fact that the nationwide paid out £3111.20 in 6 years worth of unfair bank charges. They are now closing my account and say it is because i fail to comply ;-( oh well will have to move banks. Oh yeah and they are giving me 30 days to repay my £1500. overdraft do i have an alterantive to spread the payments or not????

    Keep going all those others who r in the process !!!

  • Do you have any right of appeal Jo? I only ask because I didn't think they could do this - I got my charges back from Halifax earlier this year and they have threatened to close my account if I don't manage it properly in future but that's all.

    Might be worth seeing if theres anything on the Cnsumer Action Group website about this and also finding out what happens if you can't pay the money back - would they agree to let you pay it back over time.

    Just a thought because I think they've got a nerve!

    Hi, my bank (A&L) have just charged me £25 because one of my direct debits made me overdrawn. They've called it a 'paid item' charge and I believe they'll be a further £25 charge at the end of the month for going overdrawn plus interest. Am I able to try to claim these charges back? I've been with them almost 20 years and have only been overdrawn a handful of times so I'm not too worried about past charges but these recent ones have left me in a real muddle! £50 is two weeks food for me and my two little ones :(

  • Hi,

    I have been looking at this with interest, just came across it today, I would like to reclaim charges from my bank but I am unsure if I would be eligible to do so, story so far, maybe someone can advise if I would be able to go ahead with it.

    We are in alot of debt appox £25000, we have been paying off our debts with a DMP for the last year and 8 months, all is going very well and we have already paid back 3 creditors, however the Royal bank of Scotland, was the only creditor to continue charging us at £48 per month for unauthorized overdraft, £30 charge and then £11 for something else and £5 for account administration, our overdraft was £600 it had now risen to over £880 because of the charges and interest, we panicked and borrowed money from parents and paid an extra £285 into the account to bring it down to just below the £600, then they charged us again for the previous month and it started all over again, eventually after many letters of asking them to stop the charges and interest, we asked them to put a default on the account and it is now with their debt department and the account closed, we now owe them over £900, paying through the cccs at £6 per month.

    We have paid them over £600 in just a year it would be great just to get some of it back.

    my questions...

    1) Can I claim them if we still owe them as much money and paying with cccs?

    2) Would it jeopardize anything we already have set up with the cccs?

    3) Could taking them to court influence them or any other of our creditors to take action against us and not accept our DMP?

    Would really like to go ahead with this but I am a bit scared to rock the boat as it is all going well with the DMP.

    Any help appreciated!

    the bank are trying to skin me for unpaid charges and are covenently loseing my letter's

    today i was talking to the bank telling them that i cant pay the charges as i am off work with a dislocated shoulder arm in a sling for the next few month and there responce "get a job":mad: cheeky i asked to talk to a manager and convenently theres none avalabul were soposed to phone me b4 9 pm thats now.
    i am descusted realy am so its going to be with a big smile i receve the payments back
