Sent off a letter requesting information about my account (included £10). Received a letter today and statements dating from June 2004 to present. But, they have missed some out. This is what they say:
"Statements held prior to May 2004 are stored on microfice...date order and more than one customer statement may be held on one film. ...Not stored by reference to account number or customer name and are not ""readily accessible"" within the meaning of the Data Protection Act....Therefore do not fall within the class of documents to be produced pursuant to a subject access request. They can be obtained from our Customer Servces Dept at a cost of £3 per statement"

So what do I do now? Do I really have to pay, because if I do its gonna cost around £45

Hi you need to send them a reply there is a link at the top of this page where you will find it

    HSBS- Very unco-operative!
Has anyone had any problems? or can you offer any advise?
My sister and I are both claiming bank charges back. My bank are just being very slow at responding to anyhting, whilst my sisters branch are causing her alot of problems.

firstly after putting in a letter to request bank charges, her bank didnt pay her mortgage as there was £1.00 insufficient funds (they would normally of paid this) the second time they didn't pay direct debit for her mortgage despite there being funds in her account to cover this ( allbeit it would of gone into her overdraft facility but this is still in place.)
she contacted bank who also refused to reinstate her direct debit. They haven't refused any other direct debits just the Mortgage! Are they allowed to do this? Has any one else had the same problem?

She has received a letter from them stating that the law relates to credit cards not banks and therefore she has no claim, is this right? Are they fobbing her off? we intend to take it to the County Court but just wanted a bit of advice can anyone help?

Found it, and found the template, but I have another question. The letter goes on about Data Protection-but the letter I received from my bank say that because my data is on microfiche and is only held in datre order the in doesn't come under Data Protection. Do I still send the letter?

  • hello all
i am at the stage where abbey have offered a refund of £300 worth of bank charges. i want it all back but after two written requests and 5 phon calls, they are refusing to tell me exactly how much they have charged me over the years.

how can i sue them if i dont know the exact amount i am owed??
  • Thankyou for that, do you know if they can refuse to pay direct debit even though funds available?

    Hi guys!

I've sent two letters off to Barclays, asking them to refund £90 on my account, and £440 on our joint account due to being charged £30 a time for going over our overdraft or having things bounce. Since we sent the letters off, we went over our overdraft again, so we went in and complained about it and they gave us that £30 back (this was a couple of weeks ago) ), though we were still waiting to hear about the previous complain of 390 and £440.

This morning I got a letter off them saying basically this:

'We are sorry that you are unhappy with the charges made to your account over the last 6 years. You state that the charges you have incurred do not reflet the cost of the bank. Upon checking our records I can confrim that your account has been credited with £30 as a full refund of one of the charges applied on the 27th July 2006 by our branch. I have today thoroughly checked our records of your account and as no bank error has occured I regret to inform you that I am unable to offer any refunds.

When an account is opened with us our customers are provided with a copy of the terms and conditions...including details of our charges. This information clearly explains our obligations to our customers, as well as thier obligations to us. If you would like to talk further about this please call... I will keep your complaint open for 8 weeks and if I have not heard from you in that time I will regard your complaint as closed.'

Then they ask me to fill in a survey on their customer care. Any tips on what I should do from here? Thanks!

Hi! I posted the above quote on the 1st August when I got that letter. I've moved house and for various reasons I haven't replied to them and missed the 8 weeks they gave me to reply. Can I still send the second letter, or do II have to start again with the first? Or have I missed out completely?

they should have no reason not to pay, if funds are there.
