So if the bank do not respond in the 28days which statement do you highlight to claim on Moneyclaim?

Hi there,
After following the instructions and attempting to claim back £755.55 in 'illegal' charges from Nat West, they offered me £375 in full and final settlement. I rejected this threatening them with court and they have just written back basically saying that they will go no higher than this offer and that if I want to go to court then so be it. My questions are:
1) Does anyone have experience claiming back from Nat West?
2) Do they usually go this far and at what stage, if at all, do they usually give in and pay up in full?
3) If I go to the small claims court, how much money can I be liable for in terms of costs or anything else?
To be honest I am really unsure as to whether or not just to accept their offer even though I know this is giving in. Any help would be greatly appreciated and thanks very much in advance.0 -

Sent off a letter requesting information about my account (included £10). Received a letter today and statements dating from June 2004 to present. But, they have missed some out. This is what they say:"Statements held prior to May 2004 are stored on microfice...date order and more than one customer statement may be held on one film. ...Not stored by reference to account number or customer name and are not ""readily accessible"" within the meaning of the Data Protection Act....Therefore do not fall within the class of documents to be produced pursuant to a subject access request. They can be obtained from our Customer Servces Dept at a cost of £3 per statement"
So what do I do now? Do I really have to pay, because if I do its gonna cost around £450
