  • Can anyone tell me if it's best to switch accounts before sending out the letter to my bank. I now have details of all my charges but as I have a £800 overdraft I would like to have another account just incase they close mine. If I do switch accounts first is it ok to completly close the old one?

    If I understand correctly, then I only apply the interest if the LBA letter fails, and I have to take them to court?

    Hello, just an update first on the position i'm in, i have just filed the moneyclaim form and paid fees etc yesterday bringing the total (with interest to £4111.05), this morning i get the first real response from the Abbey - stating that the fees are not unlawful and they are fair etc etc but as a token of goodwill they will offer me £1200.00 as a final offer. I know i should reject this but how do i do it? Do i send a letter saying no i reject your offer or do i have to word the response in a certain way? I just don't want to blow it now after coming so far, -(didn't know how tempting it would be to just say yes give me the money Thank you!)

    hi if you are unsure about them taking your overdraft you are best opening a new account first allthough they do not tend to retaliate anymore. then close the account and claim your charges, go to https://www.!!!!!!.uk/forum for more info
  • Shaun, I notice from your site that you go straight for the LBA without a preliminary request for repayment.

    This gives the bank just 14 days to settle without the involvement of a Court.... do you not think that is too short a timeframe? A Court would normally expect the claimant to have given approx a calendar month, perhaps why other sites would advise 2 letters each of 14 days.

    Perhaps there's another reason though?

    Hi, 90% of people require a copy of their statements through a dpa request, within our dpa request there is the first demand for repayment, therefore they get much more than a month to respond, also bank generally now give a final abrupt reply that they will not repay any charges even with the threat of court action. this is more than sufficient to start legal action, However if the banks reply offering to look into the matter there are letters to give them more time.
    should anyone actually need to go to court there are more than enough references to the banks unwillingness to pay regardless of time given. things move on, banks change their tactics so we change ours, when this originally started the softer aproach was regarded as nescecary. However each individual case is treated as that, and there are more letters in the https://www.consumercorner/forum to deal with each and every circumstance.
