    I have had £58 in charges refunded by RBS out of court. I thought that a bank was supposed to refund the court fee of £30 as well as any charges. Is that correct? :confused:

    yes they are, you need to write them a letter stating that you require this fee refunding.
  • I'm just about to start trying to claim back my bank charges from lloyds tsb and wondered if anyone could advise me on whether i send the letters to my branch ( i have accounts at two different ones) or to their main offices and also who to address them to?

    I'd be really grateful if anyone could point me in the right direction, thanks.

  • Hi all, First post so be gentle.
    I 'm currently in the process of screwing all the companies that have screwed me in the past....oh, and this site is possibly the best consumer advice site ever placed on tinternet.
    I've just sent HSBC 2nd letter, together with breakdown of charges and claim value (£3600.00)....HSBC....I will win. Also just sent first letters to RBofS, 2 credit card companies and my mortgage company.

    My question is - Can charges be claimed for from a mortgage lender?

    Important information: I'm currently in the middle of a re-possession order, in fact they have re-possessed the property now, waiting for a buyer.
    Would any sucessfull claim be taken from the value of the mortgage owing?

    Going on a bit now arn't I......any advice welcome regarding claiming unfair charges back.

    One other point, my property has been re-possessed, they have changed the locks, deeds have been released and i'm no longer responsible for the monthly mortgage payments ( although they are still adding the monthly interest onto the balance which, cuz we had interest only, is adding £900 per month to balance...nice!!
    They are still charging me £30 per month for late payments......How does that work!!!!

    Hi,
    yes cahrges can be reclaimed from a mortgage lender with one exception, you can claim back 12 years.
    as for the repossesion, have you any idea how much the cahrges were before they repossesed? if you go to https://www.!!!!!!.uk/forum have a read at my repo thread.
    loads if info on there about caliming back your charges, the £900 per month sounds heavy.
  • Hello all, Only just found out about this whilst browsing the site(which is fantastic), and its unmissable! I, Like been getting these charges for years. My problem is I am at my overdraft limit(£1000) with HSBC and theres very little money going into my account as I run everything from a seperate account now. Im worried that if I apply for my past 6 years statements they might see what im doing and start giving me problems and demanding I clear my overdraft. I have looked at the template letter and Its quite obvious what my intentions would be. Do you think I should hang on till I,ve cleared some of it off?
    Any info would be much appreciated.
  • To be honest so are we ( £1500 limit - balance -£1680 )
    Personally I don't care if they close my account, well maybe a little.
    They have been taking money from us for a long time and we want it back.
    We are within our rights to ask for our money back, in fact to get our money back.

    if you are not using that account anymore then their would be no point in them threatening you with calling in your overdraft as all you would do is offer them a minimum payment of what you can afford, in general banks are not retaliating anymore, however can you not switch your overdraft elsewhere? ie. your seperate account. most banks will offer like for like accounts.

    One to ponder, Claiming back bank charges on your active account is good news for us, can we claim unlawful charges back from accounts that have been closed? ( i'd of thought no more than 6 years ago )

    Providing we still have account numbers etc.....
