Shaun/everyone/anyone!,
Went on-line on Friday and accessed my last 6 years worth of statements with HSBC. So anyone claiming from them do not apply for them to send the statements costing £10, you can do it for free online.
All charges do show as 'Total Charges' but I know that they are all for gonig over my O/D limit.
I felt physicaly sick after worknig how much they had took off me. I guessed at about £400, it is actually £950.50!
So what do I do now? Do I just send the LBA letter off your website Shaun? The one with the examples in (Dunlop Pneumatic Tyre Co Ltd v New Garage and Motor co Ltd [1915] )
Then do I wait 14 days and take court action, or issue another 14 days?
Any help much appreciated. I am a bit worried that I might ball sit all up.

urgent advice needed within the hour of this post please!!!!!!!!!
ok the current situation is this
we are in the process of claiming a little under £2000 back in unfair charges against unpaid DD and SO's from the NATWEST we sent the first letter on the 11th and got a reply on the 13th !!!! offering £500, so we sent he second letter refusing the gesture of goodwill and telling them they have 7 days or get ready to court!!!! that was sent on thursday last week.
The account is in my name (wife)
10 minutes ago my Natwest branch manager phoned us out of the blue, my husband took the call and stalled them saying i wasnt available so i could get my head together and be ready for the call.
so my request is this ,
1. why would they be calling , thy have NEVER called me in the past and its obvious its about this claim
2. Has anyone else ever had them call about this??? if so what did they do or try ??
i dont like been put on the spot so to be clued up would be a great help.

yes just send the lba from consumer corner, and we will take it from there.
please post on cc as well its easier and faster to answer your questions there but dont let that stop you updating on here obviously0 -

Hi, Natwest do occasionally call up to try an resolve the matter at branch level, but they will try and fob you off, just stick to your guns, dont be swayed by them its your money and if you are stuck for words just quote the case laws and consumer contracts regulations off the letter you sent.
dont accept half no matter what they say whether its "their cahrges are fair, or we will win in court, etc. etc. they will not win and they will pay the full amount. you are in charge, stick to your deadline do not let them tell you to hang on while they investigate.
remember this if you take them to court you get an extra 8%, warn them to pay up now or the claim will go up by the interest an the court fees and you will win be firm.
go to https://www.!!!!!!.uk/forum and have a quick read through the posts in there it will give you some confidence and ammo

Thank you , we will be sticking to our guns thats for sure we already have the court documents filled in and ready to go and tbh this is probably the best thing since sliced bread !!:j the £1792 that we are claiming we stated in the first letter that this was all we would claim , if they paid up in full as 6 months of statments were missing and to save time this would be our claim , , but made it clear that should we go to court we would claim every single charge not from this account but from my second account as well that has about another £200-300 so we gave them a fair deal in the first place
So frankly we want it to go to court looks like christmas will be coming early !!
To anyone else just starting to make a claim , dont be hesitant at going all the way, enjoy the ride!!! its a sweet one!! exciting and rewarding, we could have easily taken the £494 offered in the first letter and we did seriously give it some thought but , clearly today less than a week later they are already rattled.

Can I include this on my statement, or not. And if I do not include it, will I have to make another claim. It is for £125 so it is worth trying to get back. I am hoping I can include it because it will fall within the 14 days response time.thanks for all yor advice. Hi, it doesnt matter what you claim on the letter, you can alter the amount on the N1 claim form for all current charges, so dont add it to lba if its not current but make a reference to those charges.

I approached Nationwide asking for all unfair charges and recieved a letter back from them and it says in not so many words: thank you for taking the time to write to us regarding this issue, and that they are aware that there has been a lot of speculation about fees and charges in the media and that office of fair trading has issued a directive regarding credit cards.(I wasnt asking about credit cards only bank charges)and that i was well aware of this when i signed the agreement to open an account with them. Nationwide believe it is open and transparent about charges and menbers are pre-notified prior to charges being debited via there monthly statements. and that if i was'nt satisfied then i could always consider alternative banking. They have given me 56 days to come back to them if i am not satisfied with there option. WHAT SHOULD I DO?? PLEASE ADVICE THANKS.0
