  • I wondered where we stand if they don't close hte account with regard to charges in the future? Do they not charge anymore.
Although there has an OFD enquiry into bank charges just begun, nothing has been concluded, let alone accepted. Despite banks paying charges back, they have not changed anything and continue to charge the same way and to the same amounts as before. If your bank refunds your charges and do not close the account, the moment you incur new charges, they probably will.
... but you never know when the situation will change and I will be in trouble financially again.
Don’t go even there. It’s like any other addiction, you have to stop it completely. It’s like saying: “I stop smoking or I loose weight!” You just do it, and you do not contemplate that one day you might be smoking or binging again. It’s the same with our finances:

As of today, you control your money, it does not control you.

even if anything is concluded the oft are funded by the banks they will not resolve the matter just give us more ammunition to fight the banks with.

upon what do you base this? charges are unlawful, therefore closing an account will be considered retalitory action, and when everybodies account is closed and they have no definate form of payment for od's etc. what are the banks going to do. they must give 30 days notice to close an account.

at what point was this an addiction unless you are accusing everyone of failing to meet D/D's on purpose for some kind of thrill, that is an unfounded comment. there are people out there who genuinly struggle to make ends meet, and others who make genuine mistakes

to right itsyour money so claim it back and do what you like with it

I have been filling in the online money claim form. There is a particulars of claim section, do i have to put anything in particular here e.g state any parts of the banking code etc any advice for this part would be greatly appriciated.

Also i have noticed that when i got my copy statements the abbey had removed all the charges section from the front page so on first glance it looked like i had no charges. i had to traul throuh all the idividual transactions to find the charge amounts!!

I am afraid that I have to challenge your statement that financial troubles are 'like any other addiction'.... You really need to walk a mile in another man's shoes before making such statements.

    Overspending is like overeating......
I know, I have walked much more than a mile in either place (wearing my own shoes).

Yes, if you are on the wagon (whatever particular wagon that is) you might fall off. But do not start with the certainty that you will fall off.
  • Although I paid probably a couple of thousand pounds in chargres, when I left (or closed) my account I had signed a protected trust deed and owed the bank money. If I reclaim my charges will these be refunded?

Well to update you on the above

Citibank have acknowledged my firmer request for charge details and confirmed they will follow. Then I can raise the next letter.
Halifax are still considering their response to Moneyclaim (will I see a copy before the verdict), but they have said they are contesting.
LloydsTSB have just confirmed they will contest and have 28 days.

Whats the view how are things going for me?
    It pays to challenge
