  • can anyone please advise i have wrirren to first direct claiming a refund of unlawful bank charges and overdraft fees of £5000 .
    they wrote back denying the claim to be unlawful and refering us to first direct account terms and conditions .
    they quoted part 2 clause 6.9 , operating your account .
    they then quoted what this means stating that if the account went overdrawn without an agreed limit or over an agreed overdraft limit they will charge interest at their unauthorised overdraft interest rate , overdraft fee and excess overdraft fees .
    they referred us to our terms and conditions they say we were given when we opened our account .
    they finally referred us to the financial ombudsman service as they stated their letter was the banks final response .
    we believe our next step is to go to the small claims court with this matter but before we make this important decision can anyone advise us if there is an additional course of action to take with the bank now or in the future.
    are first direct relying on any legal loophole or are they stalling can anyone help.

    Hi Tracy,
    this is just the banks standard reply, what they dont seem to understand is the fact that we are claiming the charges back because of those terms and conditions so all they have done is give you amunition. your next stage is court.

  • Hi everyone,firstly a big thanks to everyone who has posted on this site, a real kick in the right direction to pull my finger out.Last night I rang my bank and asked for 6 years worth of statements. No problem was the reply, all they needed was £10 which they will take out of my account. So the first step is in motion.From the more recent replies I have read here and on the other forums it seems as though the banks (mine is HSBC) are now alot more organised, and it is going to take a long drawn out process to get anything from them.How long should the whole process take, I should have my statements by the end of next week. Am I right in saying that I then need to send the 1st letter off stating how much I want them to pay me, including any interest? If this is the case I need to input all my charges into a spreadsheet first before sending the letter.Thanks againG1W

    New DFD is 28.10.2018 due to paying the absolute maximum.

    hi, nice to see you have already popped on consumercorner ;) the length of time it takes depends dramatically on the bank and the amount allthough they do seem more organised now and draw it out as much as possible and no doubt some claimants will drop of the band wagon and cave in. however we have just had what maybe a small breakthrough in speeding up the proccess on some claims. you need to send the lba from www.!!!!!!.uk with a spreadsheet, the 8% interest does not apply until the court stage.

    Any help would be appreciated.

    hi the 8% interest is only applied at court stage, you need to do a spreadsheet for the lba letter you will find that at www.!!!!!!.uk as well
  • I have just joined and had a read around. It's pretty amazing how simple it really is. I was always under the impression that the banks were full of grown up's (I'm 26 now but you know what I mean?) that knew exactly what they were doing and I was going to look silly.

    I have read that if I follow the simple rules given on money saving expert and here and consumer corner and simply stick to my guns, it should be ok? Is it really that easy?

    Also, do you know what the chances are of them closing me down account wise? I am on benefits at the moment (though am getting back to work as soon as) and I am worried about getting another account easily. Any advice?

    yep it really is that simple as long as you follow the advice and if you get stuck cc are always on hand to write letters for you, as far as closing accounts down, that has been and gone, the oft warned them to stop.
