    hi family life if you sent the letter and spreadsheet from consumer corner then you need to go to court on the 15th day
  • hi there everybody received defence from court today and i have a form to fill in , any help so i dont mess up would be appreciated, also how long do i have until the court date ? should i start thinking about what im gonna be saying there yet ?

    Hi lee, if you go to https://www.!!!!!!.uk there is a templates to follow that helps you fill in the questionairre it depends on the amount of the claim, and no you dont need to start thinking of court dates yet, one has just come through today for next year, because they are so busy. :rolleyes: as far as their defence is concerned it would depend on what it says. if you register at the above site and post snippets of the defence iw ill be able to advice you

  • DOES ANYONE KNOW IF IT IS POSSIBLE TO CLAIM THE CHARGES FROM THE BANK IF THE ACCOUNT IS A BUSINESS ACCOUNT -- I AM A SMALL SOLE TRADER AND DUE TO BANKED CHEQUES NOT CLEARING IN TIME OFTEN GET REFERAL FEES OF £30.00 EACH SOMETIMES 3 OR 4 TIMES A MONTH TOGETHER WITH THE COST OF RE-PRESENTING RECEIVED CHEQUES ..
    I DONT OBJECT TO PAYING THE INTEREST ON AN UNAGREED OVERDRAUGHT BUT THE ADMIN COST SEEM TOO DISPROPORTINATE .
    SO DO I HAVE THE SAME CHANCE OF RECLAIMING THE PAST 6 YEARS AS DOES A PRIVATE ACCOUNT HOLDER??

    you certainly do, i have just won against my business account, allthough the wording is very slightly different. go to www.!!!!!!.uk and you will find all the info, letters, and advice you need
  • Shaun, Thanks for your reply, so does that mean then that I would need to fill the money claim form in on the 20th Spetember 2006, as I have received the letter from Lloyds on the 5th/sept/06. thanks for your help.
  • thanks for your help , the defence says that there is no breach of contract by themselves therefore the charge cannot be a penalty, consequently there is no requirement that the charge be a pre-estimate of the banks loss , also that the charges are fair and reasonable and it is denied that they are unlawful . what do you think ????:confused:

    Ive moved branch but kept the same account number, who do I make the claim against - the branch you originally opened the account with or the branch where you now hold the account.

    Or do I need to make 2 seperate claims one at each branch of the same bank or go straight to head office ?

    its the 15th day of you sending the letter to them so presume it would be about now ;)

    thats just the usual stuff, nothing to worry about. just send the questionaire back, and it wont be long before you get your money

    the branch you are with now would be the best bet at this stage. if you go to www.!!!!!!.uk you will find all the upto date adbice and letters there to help you
