  • Hi Shuan, for some reason i can't register on the webpage you quoted me it keeps saying An Error Has Occurred! You are not allowed to access this section when i tried to register. I have tried all different ways with different usernames, passwords, and email adderesses but to no avail can you suggest anything please???? THANK YOU :D

    Hey All.

    I've actually posted one of these questions on another thread, but this one is more appropriate.

    I have around 7 different credtiors whom I am currently on a self managed DMP with. I am making token repayments at the moment due to my financial cicrumstances but soon will be making greater repayments.

    Anyway, I really want to claim back all the charges imposed on all of my accounts.

    I am hoping some of you MSE experts will be able to help me out. I have already read the guide to reclaiming charges and downloaded the template letters etc.

    My first question is, can I claim from both the original creditor and the DCA? Over 50% of my current 'creditors' are actually DCA's.

    Can I also claim back charges from a mobile phone operator? i.e. Orange. I currently have a balance of £750 which seems exceptionally high, and I have been paying this for sometime now.

    My mind has gone blank now, but as soon as I receive some replies I will probably remember what else it is I wanted to ask :)

    hi, first of all you make the claim against the original creditor and the dca's will be refered back to them as your account will be in legal dispute and they cannot chase you for the debt anymore, any charges the have applied will be wiped off as it was an unlawful debt and should not have been passed on. yes yoou can reclaim from mobile phone companies innfact any company you have a credit agreement with. if you go to https://www.!!!!!!.uk/forum you will find much more detailed explanations and all the letters you need to send the dca's and creditors. hope this helps for now

    Hey there,

    I have two cases at the moment, one with Barclaycard and the other with Bank of Ireland. For Barclaycard I claimed back £180, they gave me £90 as a goodwill gesture and I started a court case for the other. The date is for 5th October and this has been set for about a month now - I've had no word from them but know that they have appointed a solictor close to where I live. I thought that refunding me the £90 would be easier than appointing a solictor and taking me to court?

    The Bank of Ireland case is slated for the 5th of October as well. There, I'm claimed back approx £4K from a business account. I haven't received the paperwork yet but they have filed a defense and counterclaim for between £300 and £600!!!

    As you can imagine I'm now quite worried. Does anyone have any experience with this/advice on what to do now??

    hi,
    first of all they are not taking you to court, your taking them. they all appoint solicitors and if you have done everything right they wont step foot in the courtroom. i have known of people have couriers approach them in the courts waiting room with a cheque sent by the bank.

    What happens though if Orange have sold the debt to the DCA? Would I need to launch to seperate claims?

    Also, who needs to inform the DCA that I have launched a claim? Me or the original creditor?

    I assume I would have to send the template letter for DPA request first asking Orange to provide the list of all the charges incurred on my old account.

    hi, you need to send a letter to the dca reffering them back to orange and the dpa request to orange, use both letters from https://www.!!!!!!.uk/forum they are upto date and cut time ;)

    I am currently on a self managed DMP. What do I do about repayments?

    Do I just stop making any payments until the charges issues is resolved?

    hi that really would depend on the amount of debt and the amount of charges as it is self manage there is no contract to make them continue with the dmp once you upset them, put a post up on cc and i will be able to advice you better ;)
