hi, yes you certainly can claim this back and any similiar charges over the past 6 years (if in England).
go to www.!!!!!!.uk you will find all the letters and answers to your questions there ;)

Are the chances of them closing my account down very high does anyone think?

I ask because for the sake of £60, I havent the time nor the patience (nor the credit record) to go round hunting for a new bank account - I'm not sure the money makes it a worthwhile act?

the chances are very very slim, they did start doing this but they were warned off by the fsa, and have not heard of any since.

    Spot on - thanks Shaun!
  • Hi, sorry if I am asking Q's that have already been asked but my hands are kinda full with a 9.5 month old and 20 month old so dont have time to read though all the posts!

Anyway, I have a sole Halifax acct, a joint acct with BOS which husband froze when he filed for divorce and credit cards. We are now thinking of getting back together but up till now nobody has made a move to sort out our joint acct which is overdrawn although the bank periodically take money out of my husbands acct to pay off excess over the £1000 overdraft on it (We got hundreds of charges for items when the acct was first frozen as some were set to come off via card, some by direct debit and some by standing order) and are currently getting charged £38 (I think) a month for being overdrawn and having no funds going in as I think this acct needs a minimum of £1000 a month.

My question is this - can I claim any of these charges on our joint acct (Their charges keep putting the acct over the limit and then they charge us again for being over? What about the charges when the acct was frozen? (Think thats what happened). Also, because I am on maternity leave I had a tough few months till i got money as had bills to pay and only SMP to live on so had lots of charges and got hammered on credit cards too etc for late\missed payments. can I claim for late and missed payment charges because they already make enough off the interest or is this just my own fault for not being able to make the payments?

Can I also chase up old, closed accts?

Is there anywhere\a link that can tell me which ones I can claim for and which ones I cant?

Will also be looking at getting my mums looked into as she has financial issues due to old Council Tax Debt - they take so much off her she is unable to pay the current years to try and get up to date, and doesnt have much left after her bus fares - as she says its just as well she can eat at work or she would starve! so am really keen to try and get hers refunded as she could do with a break. Will then pass the news round family and friends and spread the word as I believe everyone should know about this as I hear enough people moaning about it!

Oh yeah, thanks for any assistance it is really greatly appreciated!!
  • "I'm pretty sure this does not include things like cash advance fees or cheque handling fees or anything where they claim to be 'providing a service'."
    Hi Uber,
Has anyone been able to firm this up - I do recognise that some fees are legit but could it be argued that cash handling (in a banking IT environment) doesn't merit the fees levied?

I claimed back from Halifax re mortgage admin fees and sent the 14 day letter prior to Moneyclaim last week. Have today received a reply to give asking for 'more time to address my concerns' and if i not happy to then refer to FOS. Should I submit my claim through Moneyclaim or wait for their reply and assuming they do not refund should I pursue through FOS or go straight to Moneyclaim?
    It pays to challenge
  • thanks Shaun for your help, I wonder if i could trouble you for a few minutes to help run me through it, I just want to make sure everything is as it should be then I can then send the costs and letter off to them. I just a little miffed as the 2nd lot of sheets they sent show me being charged £30-00 one month for excess overdraft and then £60-00 the next month, and unpaid cheque £70-00 one month and £40-00 the next. if you could help me then that would be fab. best wishes, Paul Woods.
  • Cash Handling Fees. I know that they've been described as a service but, if that's so, why the wide variation. After all, in these IT days the typing in of a figure shouldn't govern the size of 'fee'. Anything from £8 to £28 in my case. There was also a very early piece of advice that encouraged attempted recovery of 'anything which appears unfair'. Thoughts anyone?

    hi,
you can claim all the charges on your joint account.

you can claim on closed accounts allthough same rule applies ie. only the last six years

heres a link to help you with it all www.!!!!!!.uk

as for your mum that can also be sorted out take a look at the above site and you will get all the help you need.

you can claim for credit cards, loans, mortgages, catalogues, utility companies, basically anywhere you have a contract and they have charged you a penalty:beer:

    hope this helps for now
