sabelu wrote:I claimed back from Halifax re mortgage admin fees and sent the 14 day letter prior to Moneyclaim last week. Have today received a reply to give asking for 'more time to address my concerns' and if i not happy to then refer to FOS. Should I submit my claim through Moneyclaim or wait for their reply and assuming they do not refund should I pursue through FOS or go straight to Moneyclaim?
they are just giving you the usual delay tactics if you have warned them follow it through and start your claim online on the 15th day.
they are bound by your timetables now not the other way round0 -
family_life wrote:thanks Shaun for your help, I wonder if i could trouble you for a few minutes to help run me through it, I just want to make sure everything is as it should be then I can then send the costs and letter off to them. I just a little miffed as the 2nd lot of sheets they sent show me being charged £30-00 one month for excess overdraft and then £60-00 the next month, and unpaid cheque £70-00 one month and £40-00 the next. if you could help me then that would be fab. best wishes, Paul Woods.
sorry paul im not 100% sure what your question is, if it is can you claim those back then the answer is yes. if not be more specific an i will gladly help you

Hi Uber,
Has anyone been able to firm this up - I do recognise that some fees are legit but could it be argued that cash handling (in a banking IT environment) doesn't merit the fees levied?
cash advance fees are ligitimate as long as they are not extortionate, cash handling fees are allways to high and allthough a service can be challenged same goes for cheque handling fees. they are not a penalty though.0 -
morganlees wrote:Thanks for the help. I shall certainly get going on reclaiming these charges. I'm really glad i found this site as these bank charges have always made my blood boil and i usually end up yelling down the phone at some Lloyds customer service person, which doesn't really get me anywhere!
Thanks again.
Dont you think that Lloyds customer service pepole are very unhelpfull and leave you
still after they have payed there unlawfull charges back we can have a  on them0 -
Thanks for that Shaun, will check that site when the youngest goes to sleep! Quick questions though, my mum remortgaged just over a year ago to pay off all her debts(Cost her a fortune as her credit isnt good hence why she now struggles every month), some were with DCA's - can she still claim on these or will they assume she accepted charges cos she has paid? Who does she contact, the DCA or the initial companies, and if she cant find her account numbers for any can she still claim as her address etc is still the same so surely they will be able to trace the accts? Finally as we are in Scotland, I think that means we have to go through courts earlier in process so does that mean we would have to attend or can it be processed without attending, its just babysitters and tranaportation are a problem for me and my mum is nervous so wouldnt cope with court.
Thanks so much, just wish I knew about this before my mum took the remortgage (which she did without consulting me cos of the stress of the DCA's phoninh and coming to her door all the time!).0 -
hi, yes your mum can still claim against old accounts even if she has lost the account number, as for being in scotland the proccess isnt that much different and it will not go to a court hearing, they will pay up before that.
her claim would be against the original company not the dca's it will be the companies problem that they sold an unlawful debt.
for future reference dca's can be stopped very easily and even charged by the police for harassment. they have very little if no powers at all without a court order which they very very rarely have.0 -
Hi shaun, sorry for not being so specific about my question, I was just wondering whether the attachment you sent me the other day regarding the filling in of the document for the list of charges was as easy as it appears, do you just enter the amount of each item and it adds it up for you and what about the interest charge.
many thanks again.

Hi. I would be very grateful if somebody can answer just one thing.
Can I claim back on charges made on a Lloyds Tsb current account that was CLOSED approximately 3 years ago? (Taking into account period in question would need to be those charges between August 2000 to 2003).
Thank you!!0 -
