    hiya you guessed right, the service charge cannot be reclaimed, and only the interest on the charges can be claimed which can be a nightmare to work out.

    During the last 5 years, due to severe ill health, we have had stacks of charges made on both personal and business accounts. I have all statements so could work out what these add up to. My question is, can I still claim if the accounts are no longer active. Because of our dire financial situation (made worse by stacks of charges) these accounts have been closed by the bank and they are trying to recover outstanding amounts from us. Some have been transferred to collection agencies and some are still with the bank. Can we still make claims against these and use the funds if we were sucessfull towards the amounts we owe them?

    yes you most certainly can reclaim them, this would in actual fact put your debt in dispute and hence debt collectors would have no standing and be forced to back off. there are letters to deal with the debt collectors here www.!!!!!!.uk

    the bank have trasnsfered me to the colections unit simply becuse when they added there charges theat put me over the overdraft.
    there is also one months bank loan payment in the deal.

    ik was thinking of paying the bank loan payment and telling them to take me to court for the remaining charges i hsvent started a clame for my unfair charges yet.

    do you think they will risk takeing me to court?
    after all they would have to prove why they are fair then

    hi they will take you to court, but :rolleyes: your defence would scare them off in exactly the same way as putting in a claim against them.
    on the other hand if you start your claim and then put the account into dispute over the charges they have no grounds to take you to court until the dispute is settled. so my advice is get in there first.

    if you are refering to them closing the account and asking for payment in full on the loan they cannot do this as the loan is under a seperate contract.
