i need help. ive read both this and the illegal charges thread and the BAG forums but cant find the answer to my question. i am only just beginning to get ready to ask for the stolen money from my old now closed student halifax account.
i have downloaded the prelimenary letter but i do not understand it. in the preminary letter do i ask for the 8% interest in this first letter? also some of my charges were for only £2.50 should i ask for these and ALL charges back or just the obviously exportionate ones like £20-28?
i'm missing 3 statements so im still looking for them before i begin anything...:A Boots Tart :A0 -
The 8% is claimable through the courts, so if they don't pay up by the deadline you give and you have to make a court claim, then you add the 8%. (correct me if I'm wrong anyone)
The charges you can claim back are 'breach of contract' charges such as unpaid dd, returned cheque, gone over overdraft limit. I'm pretty sure this does not include things like cash advance fees or cheque handling fees or anything where they claim to be 'providing a service'.

should i ask for this back? as £2.50 sounds reasonable for a the cost of a letter but i really don't like halifax!

which letter is for me? ive not even communicated to my bank since my account was closed and wanted to write my FIRST letter to the bank asking for my money back.
do i need
"Letter before action - Consumer version -asking for it back"
or
"Letter - Preliminary approach for repayment."

Hmmm just a thought but i sent my DPA letter to the Banks Head Office in Edinburgh and they could forward it to whoever. My bank is in a small town which is linked to another one in another town so i wasnt sure where to send it to. Now it would probably be best to keep sending letters to the Office in Edinburgh right?0 -

Yes if Iwas you I would send them recorded delivery so they can't say they haven't recieved them.Wish I could stop editing EVERY post I make :mad:0 -

Yeah i have sent them recorded delivery...har har the evil bankers, yup i said bankers - will not escape me!! hehe
Just waiting on the statements. Is this time gap still included in the 40 days notice i gave in my original DPA letter as there was a space of 3 days on receiving the letter to getting someone to send the statements...0 -

I have been through all of my statements and worked out that I have paid £345 plus over draft interest of £25 in unfair charges so have completed my preliminary letter which I will be sending out recorded delivery tomorrow. I will update as and when I receive a response.My mantra is "Never pay full price!"0 -
I want to claim back my bank charges but do not know how to register with the bank action group. If anyone could take me thru the stages i would be very gratefull.0

I've never had to do it (I started the site/forum, and so just created the user when I installed the forum software).
But if you click on 'Register' at the top, it should be fairly straight forward.0
