To be fair if you were shopping at a reputable store like waitrose (where I used to work) if this happened a customer would have been given a replacement & money back if they were sold out of date goods! I think thats the least they could do!
Also if you sent ho a letter they would probably issue a goodwill voucher too!!
I'd write to Ho if it were me!!

I agree that out of date goods should not be sold and it is illegal to sell them. You unknowingly were sold some goods that were out of code. You were given a full refund. Somewhere down the line i have complete confidence that these would have been picked up by the store, i think that a gesture of goodwill is completely not needed. An apology on the other hand is quite frankly a must!

They gave you cash back. What else do you want to do about it?

You could perhaps contact Trading standards who investigate people selling out of date goods?

But "personally" what more are you expecting?

I wasn't expecting the CS to just hand over 32p and say nothing....I wasn't expecting a free gift or anything but it's the fact it was 3 month out of date and i phoned them monday and wednesday they were still selling the same out of date products...

Personally, I would have gone for the apology and gesture of goodwill to make the experience less of the negative it has now become. Perhaps a conversation with the Duty Manager rather than just the CS staff.

    I am not sure

Spak I have great respect for your opinions on the board & really dont want to get into an arguement!

Personally I dont think Tesco is, thats my opinion created from experience, such as having worked in retail for over 5years with a number of companies!!

No offence intended but I'm entitled to my opinion as you are to yours!

an apology and a small goodwill getsure might have meant this complaint did not hit these boards, and get read by thousands of people. they reckon if you get good service somewhere then you are likely to tell a friend ... but, if you get bad service will tell five. unless you're an MSE'r then you tell several thousand all in one go !!!

Well it depends on if it was a best before/sell by date or a best before as it is not illegal for stores to sell things after a best before date

First R&R - because of an out of date promotion...... :)

Adidas Mens AntiPersperant Deoderant.....Blue tops were normal SEL but Green tops were showing £1.79 - 2 for £2.80 with offer expiring 28/02/2006....and they were next to each other!

Anyway - CS checked and refunded fully - very apologetic. SEL removed.
What should I put in here that won't upset people.........

how about an apology and a small gesture of goodwill to thankyou for pointing this out to them as it is actually ilegal to sell or provide food goods which are past their sell by date. "personally" i would contact trading standards, and hope that somewhere down the line someones !!!!!! gets kicked.

Careful you are not exactly right here.

It is illegal to sell 'use by' past its dates ie all fresh dairy, bread, meat etc,
but it is not illegal to sell 'best before products' after their best before date.
In the case of the OP this would have been a best before date.

Reason behind this with use by dates, the generally have short life and are not preserved by any artifical means (ie meat) so after this date it is calculated that enough bacterial can have accumulated to cause illness and trading standard clamp down on this as ASDA swindon realised a couple of years ago with a £50000 fine.
with Best before the manufacture states the product would be best consumed before that date, but likely if consummed after that date to still be ok for some time. A packet of crisps for example will not be harmful 3 months after the best before date maybe going a little soft though.

The store was right to only give a refund, if you wish to try for more attempt a letter to head office but it is not treated that seriously, if you get a reply that would be a bonus.
