    i placed two orders this afternoon between 4.30 and 5pm

    i managed to get quite a few items ordered, but i am not sure whether they will transpire!!!

    there were loads of items priced at 1p, however i added a £650 hd camcorder to my basket and it came up as a 1p in my basket!!!!

    i doubt if i will get my delivery, but will keep you posted

    Presumably this would work the same way as B&Qs Zanussi dishwasher if they have taken the money then you are entitled to put a claim in if you dont recieve the goods?
    Missing Tesco R&R since Feb '07 :A & now a "Tesco veteran" apparently! ;)

    Just because someone at B&Q decides to honour something like that, and makes that commercial decision, it would be a mistake to assume that anyone else (or even B&Q on another occasion) would necessarily do so.

    You would certainly be entitled to your money back, but other than that it is down to someone making a commercial decision, and the particular Ts&Cs of the company involved...

    Indeed, and as this seems like a genuine error they won't have to honour the price if they don't want to. Anyone who had money charged to their card will get a refund straight to the card I presume.

    Unilateral Mistakes

    A unilateral mistake is where only one party is mistaken and the other party knows about it and takes advantage of the error. A unilateral mistake also negates consent and the existence of an agreement.

    (i) Unilateral mistake as to the terms of the contract
    For a unilateral mistake to be operative, it must relate to the terms of the contract. This type of mistake occurs where one party is aware of the mistake and takes advantage of the other party’s error. Such a mistake will render the contract void.

    In the case of Hartog v Colin and Shields (1939) the seller had made a mistake as to the price of goods and it was held that the buyer must have realised the mistake and as it concerned a term of the contract, the contract was held to be void.

    A unilateral mistake as to the quality of the subject matter will not render the contract void. In Smith v Hughes the contract was for the sale of ‘oats’. The buyer believed they were ‘old oats’, but they were not. However, the contract was still held to be valid as the sale of ‘old oats’ was not a term of the contract.

    (ii) Unilateral mistake in equity
    Where a contract is void on the grounds of unilateral mistake, the court will refuse specific performance in equity and if necessary, rescind the contract.

    Yes it was obvious that the prices were wrong. In the B&Q case it was a believable price so therefore in theory is covered by loss of bargain.

    Many years ago I bought several things for 1p online (won't say which store) and they were honoured - but only because they actually shipped it out to me. I wasn't holding my breath, and in fact the laptop I ordered went missing in the post (i.e. Royal Mail couldn't find it). Wasn't worth my while taking it up for a refund from the firm in case more bargains came along!

    Am going to be really cynical here- marketing ploy!!
