    Looking for some assistance with sending SAR Letters.

    Both my partner & I took a loan out with Welcome Finance (agreement was through GE Money) around 2006 and cleared the loan when we sold our flat in 2007. Unfortunately, we do not have any of credit agreements or account numbers.

    Do we send the SAR letter to Welcome Finance or GE Money? Also, due to not having the account numbers, do we just leave this part blank? We can provided full names & address including dates of births, etc.

    In addition, we are currently paying a loan back to BOS, which is in arrears, can we claim the PPI back on this loan. When we took the loan out, they would not give us loan unless this was taken out.

    If you still bank with the same bank now as when you were paying the monthly repayments on this, and bank online, the account number is normally shown next to the monthly repayment, check this out if you bank online. If your unable to find it then give them as many details as you possibly can, all addresses you were under whilst with them, if in joint or single account, date of birth and so on, also any surname changes from one to the other.

    You can request for these details from either but normally the data details are sent to the lender after the sale taken place, but for reclaiming you pursue GE as these were the ones responsible for setting up your loan.
    Tweak the SAR to your requirements if you want to and enclose £10 cheque or postal order, if it was a joint account then both sign as you do with reclaiming, I am not sure if 2 separate SAR's would be required if joint, companies differ from one to the other, but ring and check with them first otherwise.

    Yes you can, it makes no difference at all, however if the account is still in arrears, and if successful, its possibly they will refund the amount to the arrears, and anything remaining and interest should be refunded directly to you.

    As long as you have the account numbers, you do not have to request a SAR if you don't want to, but that is up to you of course, and as long as you have your reasons, then go for it.

    Follow the link below, and stage one there is a reclaiming questionnaire, this replaced the template letter on this site, complete and send to GE, keep copies in case you need to refer to it again at some point, and keep copies of letters you receive.

    They normally have 8 weeks to give a decision, good luck with this reclaiming.

    Anyone ever been asked for copy of driving licence/passport to check for signature after I sent my SAR to RBS?

    I think I did on my Endeavour SAR, but cannot remember if I agreed on sending it or not, as this was some years ago.

    Cheers Di, seems kind of strange considering they get a payment every month from my name, address and bank account!! I'll check out the ICO, bank's not open till Monday now anyhow.

    Sent off ID anyway, had confirmation letter saying they are gathering the required info(made a post elsewhere) regards the SAR. Hope to get the paperwork back soon to start off the ppi claims, think I'll have 5/6 loan PPI and possibly a CC with RBS.

    I'd be grateful if someone could give this a quick once-over before I send it out? I modified it from GeorgeUK's entry on a different thread, and also took some from the template at the start of this thread (modifications italicised)

    My reasoning: Welcome Finance. I was mis-sold PPI (I was told that taking out PPI was a condition of being accepted for the loan, and I was also unemployed at the time). I also missed several payments which resulted in massive charges, which I intend to claim against, and I get the feeling from memory that the loan was refinanced at some point (The loan had interest at 3.5% monthly)
    Data Protection Act 1998
    Subject Access Request

    Dear Sir/Madam

    CUSTOMER NUMER: xxxxxxxxx
    ACCOUNT NUMBER: xxxxxxxxx

    Under the Data Protection Act 1984 and 1998, and including the right of subject access under these acts, I hereby request that you supply me with any and all historical data in your possession which relates to me and am entitled to under section 7(1) of the Act. Furthermore, under the Limitation Act 1980 Section 32, as this is an investigation into the validity of a mistake, this request is not bound by any date constraints. This includes in particular, but is in no way limited to, the following:-

    1. The original signed, executed credit agreement and any terms and conditions that applied to the account from the time the account was opened through to the time the account was closed.
    2. Transcriptions of all telephone conversations recorded and any notes made in relation to telephone conversations by your company.
    3. Where there has been any event in my account history over this period which has required manual intervention by any person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention, or other evidence of that manual intervention in relation to my account.
    4. True copies of any notice of assignment and/or default notice or enforcement notice that you have sent me, with a copy of any proof of postage that you hold.
    5. Documents relating to any insurance added to the account, including the insurance contract and terms and conditions, date it was added and deleted (if applicable), and a full and detailed financial breakdown of how the insurance payments were calculated and applied to the account.
    6. Details of all interest applied to the account, including a financial breakdown of how the interest was calculated, at what dates the interest was applied to the account, and the amount and percentage of the interest charged.
    7. Details of any collection and/or administration charges added to the account; specifically, the date it was levied, the amount of the charge, a detailed financial breakdown of how the charge was calculated, and what the charge covers.
    8. Details of any arrangements for refinance of the account from the time the account was opened through to the time the account was closed.
    9. Details of any agreements modified or made after the account was opened, including a detailed financial breakdown of how the adjustments were calculated.
    10. Specific details of the fees/charges levied by any other agency in respect of this account and a detailed breakdown of said fees/charges and what each charge relates to and on what date said fees/charges were levied.
    11. A genuine copy of any notice of fair use of my data as required by the Data Protection Act 1998.
    12. A list of third party agencies to whom you have disclosed my personal data and a summary of the nature of the information you have disclosed.
    13. Copies of statements for the entire duration of the credit agreement or details of all account transactions, to include dates and amounts of all transactions.

    Where you have used abbreviations and/or codes, I would request that an accompanying sheet be provided so as to translate these abbreviations and/or codes and their meanings, I also request an accompanying appendices of the documents included and reference to the purpose or meaning to those documents.

    I reserve the right to refer to the contents of this letter if an application for pre-action discovery is necessary relating to any of the documents requested herein.

    IF YOU ARE UNABLE TO DEAL WITH THIS REQUEST, YOU SHOULD IMMEDIATELY FORWARD IT TO THE PERSON WITHIN YOUR ORGANISATION RESPONSIBLE FOR DATA PROTECTION.

    I enclose the statutory maximum fee of £10. This fee is to be used solely for the purposes of supplying the Subject Access Request. You have 40 days in which to comply.

    Yes the SAR is fine to go, then when it comes to reclaiming, its normally a reclaim questionnaire to complete as on step 3 below.

    But with Welcome now in default, it may be a case of asking them or the Financial compensation scheme (FSCS) for a claim form, its a little different from the reclaim complaint questionnaire.
