  • Thanks for your reply K271 but i still have had no cheques to date. Just had some information from my aunt, she has relations that live in Watford and they have visited Parade House. The receptionist in Parade House told them MSOLS office is empty it is just a postal address, post is delieverd then some one calls in to collect it. So no point sending the bailiffs to an empty office. What we need to find out have they a warehouse? If so where and what the address is? Any one got any information of this or know where we can find out ! ! ! ! Thanks.

    went to court today, got a judgement against them, for immediate payment within 14 days. The judge said that i was wrong to claim for the remaining 2 cashbacks up front because they were not due,

    I explained about the fundamental breach in their terms and conditions meant i was able to but she disagreed.

    Luckily, they have become overdue since so i got the whole lot, but ive read here lots of times about the fundamental breach thing.
    Also, i was not allowed to claim for my half a days leave i had to take to attend court, i was told cos i was the claiment, i had to allow for incidental losses, why should I? Ive lost £50 now in Annual leave time. yet they granted me my travelling costs to the court! all £3 of it.

    Still at least its done now and all it involved was sitting in a room with a lady, MSOLS obviously did not turn up and she added up the amount they owed me.

    Interested to hear that. Judge said exactly the same to me. Anyway, congrats on getting the judgement.

    I'm also keeping an eye on how the bailiff route goes.

    I went down the baillif route, paid an extra £55 for the service only to be told that their registered address is a virtual office and since there are no goods to be seized on the premises there is nothing they can do.

    I cannot believe that these people are allowed to stick two fingers up to the judicial system and get away with it.

    If anyone has any ideas on how we can all get together and try to nail the !!!!!!!s I would be more than grateful.
  • I had a CCJ on MSols Ltd on the 5th of June, saying they had to pay me £273.40 by the 19th. They haven't paid me yet... Should I ring the court and ask them to send the bailiffs? It sounds like that isn't really achieving anything at the moment. Has anyone had any luck with enforcing a judgement recently?

    Personally I don't think it's worth it if it's a Virtual Office - the bailiffs won't be able to recover anything. I'm still looking for another option in this regard myself.

    You have to apply (and pay) for a warrant to "send the bailiffs" - it's not something you can just ring up for.

    Guys its a waste of time and money. I have paid £55 extra to send the baillifs in and they could do diddly squat because its a virtual office and there is no goods there to seize.
    I spoke to the baillifs myself and they told me that there is nothing they can do.

    How about if we all got together with a few names and contacts and tried to get intouch with the BBC Watchdog?

    Mobile Rainbow owe me money from early 2007, however as I live in the North of Scotland, there's not much point in taking them to the small claims court, as my travel and accommodation costs to attend the court hearing will be much more than the £250 they are owe me.

    How about getting a group together, and mounting a concerted campaign on all newspapers, radio stations etc. I dont think this will get any of us our money back, but it will stop other people from buying from them.

    I thought you could get a Court Hearing transferred to your local court? I got mine in my local city. I don't know if that would apply to Scotland too.

    I wrote to my local Trading Standards and they provided a comprehensive email reply which basically suggested chasing my Network (Orange) with a complaint;

    "Your claim is based on the fact that the retailer (agent) made promises of cashback which were unfulfilled and you now want the MPO (principal) to discharge the liabilities of their agent (the retailer)."

    MPO = Mobile Phone Operator = Orange, O2, Three or whoever
    Agent = retailer = Msols

    It looked like a standard response to Cashback complaints, so perhaps write to them yourself and you may get a similar suggestion.
