I sent them a letter via recorded delivery a week ago threatening court action if they do not send me cheque by 27th september. As advised by many on this forum after numerous issues where they simply keep on making excuses for none payment
But as yet no cheque so basically im getting ready tostart the proceedings against them. I am a little unsure about exactly how much they owe me but that can be resolved by a phonecall to them tomorrow asking them to confirm how much they owe me.
I will actually be glad if I can go ahead with the proceedings as I have now posted by third cashback claim with no signof the first being paid out to me!!
i think I should claim further compensation along the lines of £40 or so pounds for the trouble they've caused me.Do you think its worth me bothering to ask for that?have they paid out compo when its been requested in other cases?0 -
How can you not know what they owe you? Optimistic asking them! Why do people go with a company like this in the first place? Compensation is a dream. Court costs, statutory interest and minor incidental costs.0

I`m suprised anyone knows or are able to claim anything, because they do not issue any contracts saying anything other than how to claim back cashback. Nothing is sent in writing how long the contract is for, or what deal you have (9 or 10 months free??).0 -
i roughly know how much they owe me but want to confirm this.
as for using this company I have used numerous other cashback companies in the past who have always paid up as long as their terms and conditions were met.
thanks for advice with the compo0 -
Never mind what they send you in writing; don't you at least print off the details at the time from the website? It's inconceivable to me that anyone could purchase any kind of mobile contract without knowing exactly what they're supposed to be getting, what they're paying and when they get each part of the cashback? Otherwise why on EARTH would anyone go there? Sorry - already asked that!0

Nope no one does it, thats why they get away with it. You do know if you dont have it in writing then there is no contract agreement, and printing it out from the net makes no difference, because that is not a contract agreement,lol.0 -

Very sensible, because if you get it wrong it will be thrown out in a court case0 -

I had written down the required info but then lost this paper. however I have confirmed with them how much they owe and this matches the amount I thought they owed me.
Spoke to someone at their concerned department and they said that due to the letter will receive moneys owed by next friday at the latest. Having waited this long will give them till next Friday and then start court proceeding on the day if still isn't in my account.0 -
I should have received my first cash back (cheque payment) on 20 August (45 days). I called them shortly after, and was told that a BACS payment would be made within 7-10 days. I called them today, and still the same standard answer - 7-10 days!
Sent off the second cash back claim at the start of the month - not holding out for a speedy turnaround!
Will only be dealing with larger/local companies for my next contract - never had a problem with them.0 -
Just an update on what happened about the Cashback they declined saying it was Computer Generated. Mobile Rainbows said they ''honoured my claim'' int he past therefore there was not any problems when i sent print off from the Three online billing.
After calling numerous times (note i practically know all of their names there and they seem to know my house number saying couple figures out of my number they will finish it for me) I rang Bela (Cashback department) and pretty much got angry and wouldn't hang up the phone til she came up with a solution (which she didn't) she tried to find my cashback complaint email and denied any knowledge of recieving this. Even though i had sent it on Friday 21st Sept, and also the Monday and the Tuesday they still denied this.
So, the following day as promised to her i would send thousands (ended up sending about 30-40 emails) i made sure i put Delivery of each of my emails and when they Read these. They deleted all of the emails. When i rang back they said they hadn't received my emails - at this point I was VERY angry as they don't accept complaint letter through the post and emails they think they can delete easily. So i told them i have proof that they have received these, and then they ''double checked'' and confirmed they had.
This time it got so serious i used so much information against them that they knew they had to eventually pay up my declined cashback.
To cut the story short they started ringing me continously to confirm that they had sent me a BACs payment and would receive it within 3 working days - strangely i recieved it within 2 days! And they have accepted my complaint to send my 3rd cashback they originally declined.
I really wasn't too happy about going to court however if worst comes to worst i probably would have.
You have to really stand your ground with them! Fill their inbox with junk.
Oh, i was also recorded the guy whilst he was telling me all that and i got him to re-confirm, don't know if that is legal without the person permission but i kept it just to threaten them.0
