    Thought you'd all like to know I've finally managed to get some money out of MSOLS after their very familiar delaying tactics and broken promises.

    I issued an online court claim for cashback 3 (plus cashbacks 4&5 on the grounds that they had broken their own T&Cs, therefore I suggested the contract was null and void), £30 court fee and £50 compensation.

    They rang me trying to negotiate, and offered to pay all the cashbacks plus the court fee if I waived the £50 compensation claim. They later offered an alternative deal, to pay cashback 3, the court fee plus the £50 compensation. But they did neither. What they actually did was to pay only cashback 3 and the court fee, then issued a defence to the claim, which slows everything down for months as a defended claim has to be transferred to the real courts, which can easily take 6 months or more.

    When they failed to pay cashback 4 on time, I issued a second court claim, on similar grounds, for cashbacks 4&5, the court fee and a second £50 compensation. [Amazingly, they did keep their commitment to me to honour cashbacks 4&5 even though I didn't have a cashback voucher for them (Mobile Rainbow never sent them). I was expecting that to be grounds for them refusing the claim, so was pleasantly surprised when they confirmed the claim had been validated.]

    They have again negotiated with me - they really don't like paying that £50 compensation! In the end, I told them I would accept a settlement of all the remaining cashbacks, the 2nd court fee and one of the two £50 compensations (with an agreed deadline for the money to be in my bank by). If this happened by the due date, I'd accept this as full and final settlement of my claims. If it didn;t happen by the due date, I would pursue them for the whole amount.

    As always, they were wriggling and manouvering at every turn of the conversation. It really helped knowing about this forum and that they had paid £50 compensations before.

    Miraculously, after an exchange of emails to confirm the agreement, the money was in my account within days. They can pay very quickly when they decide to.

    My advice to those of you who are still stuck with them - give them notice of your intention to sue a few days after the due date (be specific when that is) with the letter claiming your cashback. When the money fails to appear, put your claim in immediately with Money Claim Online. Include the court fee in your claim, and you may wish to add the remaining cashbacks and compensation too (all of those special delivery charges soon add up). Do this with every claim. And be persistent.

    I dont know if you guys agree but I would persist for the whole amount since they have violated their terms and conditions

    Just echoing what itsamac says... Go for the full claim, as they've breached their part of the contract. They can't enter a defense based on breaking the contract, but still want to abide by it for the next phase of the qualifying cashback - once they've breached the contract, it's all over - so go for the full whack!     If they have entered a defence - does that not mean that it will now go to court?

    I can email them back and state I request the full ammount before I will consider withdrawing the case.

    If it does go to court though - do I have to attend? One complication is that I am self employed, so any court case would inevitably cost me money (time I can not work) so that would need to be taken into consideration.

    I am preparing to write to them now though, telling them I want the whole lot .

    Wow I cant believe that Mobile Rainbow is still operating. There must still be lots out there who dont know about the cashback deals and their problems.

    Update

    Have received payment in my bank today via wire transfer (only spoke to Mobile Rainbow on Friday at 4pm) they sure can pay fast when time is ticking on a court claim.

    What mobile rainbow failed to notice is that they had already paid my cashback and that I was claiming £30 court fee plus £50 compensation. They paid £170 into bank today (£140 cashback & £30 court fee) so bonus they have paid me more than I wanted. YIPPEE

    If they do notice I shall use some of their own very good stall tactics ie payment will be made in 5-7 working days, its with the accounts department at the moment and of course I shall look into it for you and get back to you. Actually I would enjoy doing it - see how they like to be lied to and played at their own game.
  • This forum is so useful to help for those of us who have been suckered in by mobile rainbow. Been waiting and waiting for cashback to be paid, because of 'technical updations' etc.

    I've put a claim in on mobile claims online as many have suggested. But I'm concerned that I might not have put enough evidence that I am within my rights to be making this claim. I have emails that from mobile rainbow that say they will pay but didn't see room to attach that information to my online claim. I'm hoping that the company wouldn't blantantly lie and say they don't owe me, and I do have the evidence if necessary to say they do.

    Can anyone give any advice on what you should write in your statement (proper name might be submission?? I mean the long bit where you state your claim) for these online claims? I'm entirely unfamiliar with how these things work and find the whole notion of putting in a claim to court a bit daunting!

    An advice on what to write for my 2nd, 3rd and 4th claims (inevitable, I'm sure) would be much appreciated. Thanks.

    Having successfully (at long last) gotten all of my cashbacks paid by MSOLS, with very great effort and persistence on my part, plus 2 court claims against them, I wish the rest of you still stuck with them the very best.

    Thought you might want the contact details contained within a defence lodged by MSOLS with the court - very interesting they are too.

    Up till now, whenever you phone the Watford phone no, you only seem to get through to someone who claims he is just a warehouseman. But it seems there is at least one director in the UK (and bound to be more), so feel free to contact him direct.
