I do have arrears, however I thought someone else on here told me that if it was misold, then they have to refund me? I am now putting a letter together to go tomorrow so hopefully they will get this by weds, fingers crossed a response in the new year.

Yes I believe there have been posts where also in this situation that many have still been refunded direct to themselves.
Its worth putting a letter together - definately, and state that you were out of pocket due to this, and you believe that the money should be refunded directly back to you (back in your pocket).
I would give it a go.

Just another thought. The account is in arrears at present however I have the PPI claim and a charges claim lodged with them. Not knowing the value of the PPI, do I propose that I offer any refunds due to me ( I know they won't outstrip what I owe) as a final settlement on the account and any defaults be removed?
Any advice?0 -

I would write and question them on this, tell them your not fully aware of what is what with both the PPI and the charges as nothing have been made clear to you.
However, in some cases as well, if the refund have been made towards the arrears, then to what I am aware of is that is there is anything remaining of the refund, this at least should be refunded back to you.
I would try to argue on this though if you can, as it seems they have accepted liability to mis selling.
1. They should be actually putting you back in the position as if PPI never existed.
2. I would try demanding the full repayment to be refunded back to you.
3. A full detailed written breakdown.
It should not go back in their pockets, if the PPI were not added in the first place then you would not be in this position now.
I am not too sure on the default side of it to be honest Putty, but I think its worth getting some advice on this, again maybe this would not have happened if it wasn't for the PPI issue.
You could actually try writing a post on the debtfreewannabe thread on this one, because I am aware that there are many in the same situation who have reclaimed, and are trying to get defaults removed.

What about this a reply-
I do not feel your letter has offered a satisfactory justification that my policy was sold fairly, reasonably and within my best interests so I request that you look into my complaint again. At this point I would like to point out the following facts to you-
You refer to the account being previously administered by HBOS and that I was aware that MBNA became the provider of the account in June 2005. I have never received any correspondence from HBOS in relation to this account whatsoever and at this moment in time believe that you are trying to dispute my claim through a smokescreen of lies, a fact that the FOS would rule in my favor. I will therefore not be pursuing HBOS as this account has never been anything to do with them.
You have failed to consider any of the points raised in my previous letter dated 27 October 2009 and by enclosing a copy of this , I reiterate the contents of this and would ask you to seriously reconsider these before further action is administered.
I require a full schedule of all PPI charges that have been applied to this account with the sums of interest due as part of my refund. The sum you have offered as a refund is derogatory and in no way represents the sums of money paid out on this account.
As you have unlawfully deprived me of these monies, I am due a direct refund, not a credit against my account as you propose.
Your comment about this being your final response is noted, however as this has been your only response other than the usual stalling letters received, this is not acceptable and therefore under the rules laid out by the Office of Fair Trading, you have to respond to this letter before I refer this matter to the FOS or the courts.
I appreciate that the account is currently in default, the mis-selling of PPI being the prime cause of this, however in order to close this issue once and for all, I would be prepared to write off any claim for mis-selling of PPI against the full sum outstanding on the account with any defaults being removed by yourselves and the appropriate credit reference agencies being notified of the same.
This letter has been sent via recorded delivery and from the date of receipt I expect a full response within 14 days. Should you fail to do so, the matter will be reported to the Financial Ombudsman Service, the Online Claims Court and if I continue to be treated with a complete lack of respect, then I will notify the BBC’s Watchdog whom I am sure would be interested in your lack of customer service.

Hi
Been claiming ppi for my mum since May from Clydesdale Bank. She had 2 loans with them over past 7 years and 1 is paid off now.
She got phone call from Ombudsman today to say they have accepted first loan was mis sold but not the second!
They are going to send her letter in post tonight with offer. The Ombudsman said they are going to look into the other one for her. Dont understand why they can say one was mis sold but not the other! any ideas?0
