PPI Reclaiming Discussion part 4

  • Hi Richard,

I can see you have had good advice from the wonderful Di as usual. Just wanted to give you my experience. I went through Loans.co.uk for a loan of £10500 and they placed me with First National in August 2005. I settled the loan in March 2006. I wrote a letter to Loans.co.uk in October 2009 using the letter template on this site.

I had a reply after 2 weeks to say they were looking into my complaint. I received another letter on the 8th November saying that they don't believe I was mis sold the policy but will offer a refund of what I had paid (which was for 6 months before paying off the loan) and they stated they needed time to contact the lender to see how much the refund will be.

As the original PPI was for £1695 I wrote a letter back to them stating that I would like to be put back into the position I would have been in had I not taking the PPI in the first place.

I then received a letter on the 16th December to say they are going to refund me the whole Policy amount (£1695) plus interest of £120 on what I already paid towards the policy which was 6 payments. The letter stated that they aim to send the cheque within 2 weeks of my acceptance so just waiting for this now.

I am not an expert, but it would seem that it is the broker that sold the PPI (Loans.co.uk) and not the lender in my case First National.

This is my first post, so sorry if I have rambled on a bit!

    Hi THere

RBS bank charges they are correct that they are not paying out at the moment. THE OFT are deciding after their recent defeat whether to proceed further with this.

Lloyds I would give them 2 to 3 months to receive your payment. This seems to be the normal at the moment.

With your third one you usually give them 8 weeks to respond. It is usually best to send letters by recorded delivery so you know when they arrive. After the 8 weeks send them a further letter saying that if you do not hear you will take it to the FOS. I would try to get things sorted at branch level though rather than FOS as the wait is at least 18 months at the moment.

You could e mail the directors but I think you will no get very far. There are so many people claiming that they have systems in place to deal with this at the moment.

Good luck and keep us posted.

You have stated that the RBS are correct, regarding bank charges. This is for a PPI claim is this still the same, that I am on a loosing battle ?

    That they will not pay?

I think maxdp thought it was bank charges. If it was PPI then you can still claim and go to FOS.

As always, thanks to Di & Marshallka for their prompt and insightful replies. My first instinct was/is to wait it out until New Year with LTSB. I'll keep everyone posted - hopefully my experience with them will help others on here with the "dreaded" Lloyds.

    Your very welcome.;)X

    Hi Di,
Thanks I will read this letter again but I also remember them saying in the letter that at the time of online application my husband was a receptionist (its his account) ha ha obviously wrong so whether we mis typed it when filling the online form in i dont know but my husband is not a receptionist and he is self employed so we would not have needed it..
Thanks again I am well and hope you are too..

  • Hi everyone, I just wanted to give people trying to claim back from Black Horse some encouragement - IT CAN BE DONE!!!

I've just posted back my acceptance form today for £3,195.26. This was from two loans which I took out prior to 14th January 2005 when Black Horse became subject to FOS. I've put all the details as to what I did on the success forum.

GOOD LUCK EVERYONE and MERRY CHRISTMAS!

    Hi all,

    Can anyone Help?

I was on the phone to RBS today asking why the letter I sent to them, in reply to thier letter stating that they are looking into my claim and they should get back to me in 8 weeks well that time line past. So I called them and they have stated to me "that they have been told by the FSA to hold claims until the final decision by the FSA has been made" is this a bluff or not?

Should I send the second letter to them?

    2)
I have been told that Lloyds are upholding my complaint and they will settle with me, That was nearly 2 weeks ago. How long do you need to wait before hassling them?

    3)

I have sent the 1st letter to Black Horse and the refused, so I sent the second letter to them and they have progressed the letter to up the ladder. it has been nearly 6 weeks since they recieved the letter, as I called them today and they stated they recived it on the 7th November. Do you think that I should send the final letter or again is this a stalling tactic?

I would be gratefull for any advise, and I would againg to thank the owner & contributors to this well designed and informitive site for the Joe Public. It is time to rise up against the big boys!!!
the RBS response sounds like a bluff to me - haven't heard that one - they have 8 weeks in which to provide a final response. Once the 8 weeks have passed you can take your complaint to the Financial Ombudsman Service if the company came under the jurisdication of the FOS at the point of sale, but it's better to be able to show you've chased a response
  • I have come to the conclusion that we are all a right bunch of debtors in this forum, shall we all arrange group councelling? ha ha:beer:
