  • Evening everyone

Hubby had reply from HSBC we are reclaiming PPI missold against loan.

Letter is from branch " We have had notification that you wish to restructure your personal loan. To enable this to take place you need to arrange an appointment in the most convenient branch within the next 10 days from the date of this letter"

Hoping that this means the claim is upheld and the letter telling us has taken longer than the branch letter. Next paymwnt is due out in 10 days so makes me think this could be the case.

Will give it a day or two and then ring and ask what the letter is about.

Any thoughts or anyone received the same, thankyou :T

    Hi there

    Good luck with this.;)

So basically it looks like they want you to take out another loan to pay off the other, the new loan will not have PPI, so if you do this make sure the rate of the loan is the same as this existing one or better if you can.

In regards of the mis selling part, just make sure they don't talk you into anything you don't want to do, you can always tell them you want time to think about it and get back to them, even if its in writing.

Hope this helps, good luck, please keep us posted.;)

    Hi marshellka

I rang the fos about this case originally because i was originally sold the loan by hsf i did not realise it was now capital one homeowners loans. They sent the first letter off for me and capital one rejected this saying they are just brokers and not finacailly advisers that took 4 weeks. So I wrote back with the second template letter and added that when we settled the loan after 2 years we did not get a fair rebate and that the rep in the first place when I queared the ppi they said they did not provide loans without ppi that letter was sent 2 weeks ago .

    Thanks for the help
Hi mollymoo, So i take it FOS are actually aware of the complaint then if they wrote for you. As soon as 8 weeks are up from first complaining you can ask FOS to get involved if you wish and good luck on this one. I would add though that your complaint seems more of a missale to me and I think that FOS will treat it that way as the rebate complaint usually goes against the actual insurer.
  • do you think theis might not be worth persuming then

    Thanks

who was hsf were you thinking they were part of Capital One bank plc because I don't think they are - Capital One Home Owners Loans are no longer registered with the FSA, when did you take out the loan?

You can start a separate claim for the unfair rebate against the insurance policy underwriters - do you have any of the policy documentation?[/

if you're claiming mis selling then you're telling them you don't want the insurance - so the restructuring may be just to remove the ppi - but that doesn't automatically mean they've upheld you complaint - but I do hope you're lucky and they have

Thanks tiggrae :hello:, we are trying not to get too excited about this. If we do not receive anything re the claim in the next couple of days will get in touch with branch.

Do you happen to know if we do the restructure does this have any effect on our claim, shouldn't do should it?
