    Hi all, seeking help with 3 LTSB PPI claims appologies if a bit long winded,
    sent 3 recorded delivery claims on 30/09/09 (now think I should have sent them all in one letter as they ended up on 3 different persons desks) 1st reply 29/10/2009

    "I have decided to uphold your complaint and offer to settle your complaint in the following manner which is in line with the standard redress remedy recommended by the Financial Ombudsman Service. The offer I propose to make involves two calculations.
    Calculation One,
    I will calculate the difference between the settlement balance you have paid on the loan and what the settlement would have been had the PPI premium not been added to your loan.
    I will then calculate an 8% interest payment on this sum from the day the loan was settled to the day the calculation is completed,
    Calculation two,
    I will then calculate the amount you have paid up to the date of cancellation and refund this back to you(insurance payments ony)then add simple interest at 8% per annum to each monthly payment from date each payment made to end of loan, a further 8% simple interest per annum will be calculated on on this total amount from date of early settlement to present date.
    The 8% simple interest amount will then be calculated when I recieve your signed acceptance so that the calculations are correct and accurate.
    As you recieved a partial rebate of £349.68 on 02/01/2009 this will be taken into consideration when calculating the refund. goes on to state that these calations are exactly the same as will be used by FSO if I decide to go direct to them. So I will be accepting this offer I do not know how much I will get back so if someone could please give an approximation using following info would be gratefull.
    LOAN £10,000 APR 7.9% Purchased 09/12/2004
    LOAN REPAYMENTS £154.01 per month.
    PPI LOAN £2538.14 APR 7.9% Purchased 09/12/2004
    PPI LOAN REPAYMENTS £39.10 per month.
    !st payment 09/01/2005
    last payment 31/12/2009
    TOTAL LOAN £12,538.14
    The two other claims, both went 4 weeks then letters asking for further 4 weeks(agreed) then on last day letter from each desk saying that "sorry for delay I am not in a position to to complete a final response, if unhappy go to FSO, be assured that I will continue to investigate your complaint, expect to give full response shortly, can I provide any more information as decision will be made on evidence available to us, cannot review this decision unless you can provide us with new evidence we have not already taken into consideration.
    They have loan agreement and policy numbers for both claims, do you think it would help if I was to send them both a full copy of the decision that was upheld and ask what other type of information I can give them, also tell them that I will request a SAR to help me with their request(will do that anyway for me and my wife). Does anyone know what they want. One PPI started on 08/11/2003 finished 08/11/2004 other finished 08/10/2003 can furnish them with carbon copy loan agreements with APR and monthly payment amounts for loan and PPI for both loans or wait for SAR but will contact them and ask what kind of evidence LTSB expect me to have that they do not have.
    These loans were for the refurbishment of our home and were all settled early but I ran out of funds twice, asked bank for more funds to finish our home, bank re-arranged first loan by creating a new loan enough funds to settle the previous loan and more to carry on with improvements did the same with second loan this became the third loan which was settled early with my own funds(crap endowment policy matured plus redundancy pay out ).

    Do not worry if you did not put this into one letter, it does not actually make any difference, as they do tend to split them anyway.

    Hopefully someone will be along to take a look at this for you.

    And your entitled to ask them to post you a full detailed written breakdown on each one as well.

    If you want to request a SAR there is a template letter here for this here, which may be useful to you, you enclose £10 postal order or cheque payment for this and they have 40 days max to send this to you.

    if they've upheld your complaint for the first loan - it's likely they'll do the same for the 2nd and 3rd - the mis selling will have been on the original loan then the PPI would carry forward onto the other loans - I'd write back to the claims handler who's upheld your first complaint with copies of the other two letters you've sent and point this out to them.

    I wrote to Egg regarding my PPI and was told because it was an Internet application they had mis-sold anything although I am certain this box pre-ticked.

    I asked for copies of the application and they only sent me screen dumps of the screens completed during the application process but again I believe this to be manufactured by Egg so they only show what they want you or FOS to see.

    Having had the response from the FOS i feel somewhat let down and I have until the 15th December to challenge the decision but unfortunately I am unsure on what grounds I could challenge it. My original claim was for being advised it would help my application with the Credit Card.

    I know Egg have been fined and aren't the greatest but I feel this will not stand up against the FOS.

    Any ideas?

    what were your reasons for the mis selling and why didn't the FOS uphold your claim?

    The reason I stated to Egg was that I was under the impression that the PPI had to be taken out with the Card, but when I thought about I didn't actually remember taking the additional PP!.

    So having done some digging around on this website I came to find that the PPI box was pre-ticked back in 2000 when I originally took out my Egg card. So when I contact the FOS I stated this but they said because it was a internet application I must have been fully aware of the PPI!

    Also during the last 18 months I tried to cancel the PPI the person at Egg told me that it wouldn't be possible and advised me against cancelling!

    I just need to know how to word my leter properly in response to the FOS because I am not sure it's been looked into thoroughly.

    Hello Longword, I hope you win this fight. I lost with the FOS with my card because of Eggs screen shots which didnt prove I selected PPI and also had lots of mistakes in what my income and outgoings were but the adjudicator didnt comment on this! Wish I knew then what I know now and I would have asked for it to be looked at by someone higher. Its too late for me now but it makes me cross Egg got away with it.

    Hi Longword, was your complaint originally that Egg had told you that by having the PPI it would help in your application?? If this is the case and you applied online then this would be classed as a non advised sale whereby Egg would have not advised anything. I realise you are pretty miffed at the FOS but was the box perhaps pre ticked?? If it was then there is a chance that you could still win but certainly not by saying you were advised that the PPI would help in applying unless of course you rang them first and could perhaps prove this???

    So sorry how this has turned out:confused:.

    I rang the fos about this case originally because i was originally sold the loan by hsf i did not realise it was now capital one homeowners loans. They sent the first letter off for me and capital one rejected this saying they are just brokers and not finacailly advisers that took 4 weeks. So I wrote back with the second template letter and added that when we settled the loan after 2 years we did not get a fair rebate and that the rep in the first place when I queared the ppi they said they did not provide loans without ppi that letter was sent 2 weeks ago .
