    sorry to bother you again Di3004, but my wife just told me that she dont think we made any payments on the original loan. does this affect my claim in any way? i dont think it will because the second loan they forced us to take out was for more than we origialy agreed on the first loan as it was to pay off the original loan plus the PPI PLUS the intrest on the original loan, am i right in thinking this?

    that is fine, ask away when you want......:D

    I would write about both anyway and see what happens, just in case, they still have to deal with the main one you have if you know what I'm saying.

    Write both account numbers on the same letter and see what they come back with.
    The worse they can actually say on the one is "no payments have been made" but they will continue with the other.

    So keep it to one letter, and write both account numbers.

    thats what i mean di, i cant find the original loan agreement so i cant find the account number. is ther any other way of obtaining the account number? i should imagin LTSB will have this on file?

    just ring lloyds and ask them

    you need to claim against both, it's likely that the mis selling actually took place against the first loan and that was carried onto the 2nd

    We received the usual response, just on the one loan ppi from lloyds TSB, that they will do their best to provide us with a decision within the next 4 weeks, and if they are unable to provide us with a final decision they will send the FOS information........the usual really, so we shall wait and see.;)

    Please remind me of when you taken out the loans hun....what year?
    Also as Tiggrae have also suggested, if you ring them they should be able to also provide this to you, or request for your agreement by sending a £1 postal order or cheque payment by giving them as many as your details as possible, this includes if joint, yours and your wife's full names, date of of births, addresses and so on

    i think the original loan was taken out around 3-4 years ago so maybe 2005/2006. the second loan would have been around 1/2 days later.

    That is fine, they should still hold these details then.

    Ask for the account number on the ones you do not have.

    They would have included the ppi in the settlement of the first loan into the existing loan, so PPI is still reclaimable on the other as well.;)

    Depending on how many agreements you require - if you do not have any of them then, just write:

    You have enclose two £1 by (postal order/Cheque payment) to request for both agreements on the two loans taken out as from 2005 onwards, and you expect to receive these by 12 days from when they receive your letter of request.
    Post by recorded delivery.
    Of course give them further details as well to make it easier for them to track them down, name, date of birth and so on.:beer:

  • I can't believe just how crafty these companies are! I have been writing here on behalf of my partner who had a £15k loan 2 1/2 years ago with Halifax (for a 3 year loan). They added £6k to the loan advance, which appears to be PPI premium, and they have been adding interest monthly on the WHOLE amount it seems!!!! None of their paper work is clear with figures. Our claim of mis selling is due to my partner now being unemployed and them saying he needs to close his company as he was self employed (which, in their terms is decided upon by what class of NI he has been paying, self employed = class 2, employed = class 1), he has been paying class 1 as discussed when he negotiated the loan originally. Its infuriating.
