    Thanks, Definitely missold, hubby was cold called by his bank for this loan to consolidate debts, when he got paperwork through he queried the agreement slip for PPI as it wasn't discussed during the loan arrangement, and was told he would not get the loan without and it would have to be reworked at a different rate if he changed it, without explaining that PPI was adding a further £6k of debt

    If you want to request a SAR there is a template letter here for this here, which may be useful to you, you enclose £10 postal order or cheque payment for this and they have 40 days max to send this to you.

    Thank you for your advice will be sending copies and also phone LTSB tomorrow and as I have just replied to DI3004 what a great forum.
    Just realised that in my reply to DI3004 I said that I would phone LTSB today I do not think that my call would be answered at this time of night

    when did you take out the loan ?
  • I took it out in 2003 and settled in 2005

    I'm not sure the FOS would be able to look at is as it's probable they didn't come under their jurisdiction in 2003, but you could put your complaint to them and ask - I'm trying to see if Capital One Home Owners Loans is a part of Capital One bank plc - does any correspondence you've received back have the Capital One logo on - because if it is they did come under the FOS in 2003 !!

    The other thing you can do is claim an unfair rebate against the PPI policy underwriters as it's likely they did come under their jurisdication - do you have any of the policy documenation still ?

    If fos wrote on behalf of Mollymoo then perhaps they are thinking of taking the insurer for misselling. I know that FOS are accepting complaints against insurers for misselling and its a lot more to come back than these rebate complaints. Do you think that perhaps mollymoo would be better going this way?

    if it's capital one bank then definately go against them for the mis selling, but you know my views I think a two pronged approach (ie mis selling & unfair rebate) gives at least 50% higher chance of getting at least some money back if you've settled earlier
