shooby, if you have sent these into FOS within the 6 months then that should be OK. If you orginally complained about them both then this again should be OK. I would just ring the FOS again and check and try to stay on the line until you have an answer perhaps.[/QUOTE

Thank you Marshallka:D your allways there to talk some sense

another worry i have is the fact that when they now start to request info for the loan they havnt actioned is this gunna push my claim to the back of the queue with regards to waiting for an adjudicator, as you can probably tell i am soooo frustrated
I had four loans with my bank and complained about each. The bank actually made a goodwill offer on "one" of them but it was then passed to an adjudicator and the whole of them were looked into. I would think the same would happen to you as its the same firm. If you have proof of complaining about both and they have not bothered to address both then its their fault and not yours. FOS will usually deal with as a whole.

I'm on a DMP with Payplan and they do offer a 'Protect your payments' plan. It is the payment paid to them that would be protected. They take the charge out of your monthly payment, but it is not compulsory and they do not push it if you say no (which I have).

Hello i am wondering if you could help me.

I took out a personal loan with Welcome finance in 2003 (i think) but paid it all off early in 2006. i am now wondering if they mis sold me insurance and i am now thinking of reclaiming if so. My only problem is i have no paperwork about the loan as i shredded all the paper when i paid it all off (silly i know!) so i have no account number and so on.
Can anybody tell me how i could go about getting these details?

    Many thanks

    Hi Clare, ;)

I would request for a subject access Request (SAR), there is a letter template for this in the below link.
    http://forums.moneysavingexpert.com/showthread.html?t=1475553
You have to enclose £10 postal order or cheque payment for this request and they have 40 days to comply, post the letter by recorded delivery.

Good luck, hope this helps and ask for help when required.

  • Hi all, firstly thanks to everyone on this site, there is alot in helpful info on here and its much appreciated.

If anyone can help I have been claiming back my mis sold ppi from black horse for some time.
I paid the ppi for about a year or so before clearing this when we remortgaged. on looking back through the paperwork we paid £2500.00 as early settlement for the ppi. If they agreed to pay back the ppi for the 12 months surely they should pay back the early resettlement because it was mis sold in the first place....What does everyone recon???

    Any advice would be great

if they uphold your claim they should put you back in the position as if you'de never had the ppi - so that should include the early rebate, when did you take out the loan / ppi ?

you should be OK, black horse deny every claim, but as yours was taken out after jan. 2005, at least you have the option of going to the Financial ombudsman - jan. 2005 is when black horse came under their jurisdiction

great thanks for this at least I can go with that option.
I have emailed the director of black horse ppi.
Apparently 2 people have emailed him directly and had an offer within 24 hours. So I though I have been trying with them for for ages that I would give that a shot. Got nothing to loose hey!???

The payment to the Debt Management Company.

The Debt Management Company have "sold" him PPI apparently this was done over the phone when he agreed over the phone to all their arrangements to clear his debt in 15months.

I have asked for a copy of the recorded conversation they say there is a charge of about £15 ( I have agreed to pay when they confirm) also I have asked for a copy of the policy which my Grand:eek:son does not have just the Protection plan Payment Summary.

Angrynan - have you checked that your grandson wasn't paying PPi on the actual loans he took out - if these were missold he would be able to claim on them even though he is in a DMP
