    HI beth,

unfortunately you will as DAF reject every claim put to them - you won't be able to your claim to the FOS as they didn't come under their jursidiction when the policy was sold, you can of course always start proceedings against them - this will be your only recourse, but be careful before you do

So really I wont get anywhere with them? If the decline a claim there is nothing we can do?
Just wondering how I can be careful :o SOrry If I sound dull, I was just going to send a letter and hope for the best, but it doesnt seem that will work really now.
Did you try and claim PPI from them? did you get anywhere? x

    hi beth,

sorry, think you mis understood, you can start proceedings against them in the County Court - but you have to be careful to get all your paperwork right otherwise your claim can be struck out and you end up liaible for costs - yes, I've won against DFA twice, but both times I've had to start proceedings against them in the County Court - I work for a claims management company you see so I deal with these companies everyday

Thanks for explaining :) Seems really daunting to be honest, especially without any paper work and just figures written on a piece of paper.
I may just try my luck with letter, if no luck then I will have to let it go. I was scared enough going to court to settle my childs car crash injury claim let alone trying to fight a missold case :(

Thanks again for takign the time to help :) I will update when they throw my case in the bin lol x
  • :eek:Can anyone tell me if they have experience with Debt Managment Companies. I am trying to help my Grandson who entered an agreement with one some 14 months ago. He still owes as much now to his creditors as he did when he took out some 14 months ago, he is paying a Management fee, PPI and still incurring bank charges. I have tried to reclaim Bank charges using the site but as he is a young lad living at home they have relpied he is not a hardship case. Now I want to try and get his PPI money back

Beth I hate it when that happens.......... I know how you feel here, but in this case then contact the FOS instead, with one of mine they were not governed and the FOS sent back the details to me a few times, however, they are taking this to the underwriter/insurer group instead and the loan business dissolved.

Can you remember who the actual insurer was for the finance business?

Its just another direction you can try to take this.;)

the best thing to do in your case is to start your complaint but also to request what's known as a SAR subject Access request, you need to get your claim lodged soon as you're also beyond the 6 years under the limitations act - so it needs to be done quickly

Also, don't be intimidated by starting proceedings - you never know they may just cave - they have done with me !!;)

you'll always get help on here !!

not quite sure what you mean in respect to him paying PPI? PPI on one of his loans or against the payments to the Debt Management Company?

    Hi and welcome.

Do you know the name of the claims management company?

I did use one but withdrawn before it went much further.
If your worried about the claims company you can check them out here or contact the MOJ (Ministry of defence) here:

The one and only "Dizzy Di" :D
  • Can anyone tell me if they have experience with Debt management Companies selling PPI.
I am trying to help Grandson, first with bankcharges to no avail as he is not considered hardship case as he still lives at home with Parents

Now with the PPI he was sold when he asked a management Company to del with his debts ( The Debt almost all Banc Charges)

He still owes as much now as when he took outthe agreement with He Managment Company but has the added expanse of their fees plus a Bank Fee Plus a PPI , He has paid more than was originally outstanding some 14 months ago.

The payment to the Debt Management Company.

The Debt Management Company have "sold" him PPI apparently this was done over the phone when he agreed over the phone to all their arrangements to clear his debt in 15months.

I have asked for a copy of the recorded conversation they say there is a charge of about £15 ( I have agreed to pay when they confirm) also I have asked for a copy of the policy which my Grand:eek:son does not have just the Protection plan Payment Summary.

well that's a new one on me !!!! what exactly are they protecting against, presumably the payments he's making to them but surely he's only making nominal payments to them ,so he shouldn't be paying too much in terms of monthly payments - how much are they charging him for this insurance ?
