    In your case, give the Financial ombudsman service (FOS) a ring, and let them know about this and ask if there is another way you can pursue this, for example the insurers/underwriters etc.

    Mine was July 2004.
    Are you still paying for the loan or settled?

    If you ring them, please let me know what they say, as it will also be a help to me as well, thanks hun, as I am also trying all over the place with these right now, so it will be interesting to know what the FOS will suggest to you.

  • I have cleared it off but will give FOS a ring ,I will tell you how I get on .once again thanks for the information.

    Cool, same as me then, it was a 25 year loan and paid if off by taking out another loan with another lender in Nov 2005.
    Hopefully the FOS will give you some advice on where to take this then, look forward to hearing from you, fingers crossed.;)

  • Hi Just spoke to Fos they say it should be covered by Firstplus and Have sent me out complaint form

    Brilliant, so they are requesting that you go back to the lender then?

    And as you have already tried and were knocked back from FP, they are now sending out the form, that is great news, well done and please keep us posted.:T;)

    Hello all

    I need some advice please. I have been trying to claim back my PPI from a Tesco Finance Personal loan. I recieved a letter saying they could find no evidence of me being missold the PPI but as a 'goodwill' gesture they are going to give me £750.

    I am in a dilema as to whether to accept this or not. Are they by offering me this amount kind of admitting that there was some wrong doing on their part? If I dont accept this and try to reclaim the full amount (which is double what they are offering) is there a chance I could end up with nothing back??

    I dont know what to do any advice would be greatly appreciated! Kelly.

    That is great news for you that they are accepting this under Firstplus. I had similar problems as you in that the Broker was not regulated so I sent my complaint to FOS against Firstplus as they said they would accept like yours. I actually got to an adjudicator and they threw out as they said that Firstplus cannot be held responsible for it. I then resubmitted again against Barclays T/A Firstplus and again it got thrown out as not against FP. I then resubmitted my rebate being unfair against FP and FOS threw it out. All this took from April 2008 until October, 2008 for them to tell me all this and I eventually spoke to a manager who told me that my complaint could not be held against FP as FP were not responsible. I am only telling you all this as FOS accepted my complaint three times and then got told by FP (apparently FOS says they accept any complaint and its then up to the firm to actually argue the jursidiction issues) that THEY were not allowed to look into it. I was told that FP can actually be the ones to object and as in my case they were right to do it as they did not sell it.

    I really do hope that they can help you in this as I had a run around firstly from FP and then also the FOS.

    Hi Kelly
    If your not happy with the offer (I don't blame you), as that is a standard offer, of looking at it as a goodwill offer.
    You could write back and tell them your not happy and strongly believe you were mis sold and would expect to receive back all the PPI you have paid, if they do not do this then you can always go to the FOS.

    Right Di, got it now

    You sent your complaint to Endeavour for the rebate of your PPI but Endeavour were your lender. Now can you remember that Endeavour got back and stated they were NOT under FOS jurisdiction until 2007. We always found this strange but Endeavour were actually appointed representatives of


    Pinnacle Insurance PLC 110866 14/02/06 to 30/09/2008
    Hamilton Insurance Company Limited 202671 23/10/06 to 01/11/2007
    Hamilton Life assurance Company Limited 139618 14/01/05 to 31/10/07
    HFC Bank Limited 204483 31/10/2004 to 7/12/2004
    HFC Bank Limited 204483 01/11/07


    Now what date was your loan with Click taken out as if FOS are accepting against the lender now (like with Click and FP above) then you should be able to resubmit and them accept against whoever was the actual PRINCIPALS of Endeavour at the time of your loan.

    EDIT

    Just found it was actually taken in July 2004 and apparently NO-ONE was their principals for those dates. This is very strange.This is how they are all getting away with not taking responsibility as HFC and Hamilton were not their principals until after your complaint date.

    Also Endeavour were not under the FSA until October 2004 (and yet they repossessed my house before that???) and your loan was sold in July 2004. Who is mentioned on the policy as being the underwriter of the insurance and what exact name?
