After 2 years of correspondence with MBNA and payment protection cover on two credit cards, I have finally had partial success in that they are agreeing to refund me. My applications were made in writing, back in 1998 credit card companies were flooding us with mail and attracting us to join up. In their belated reply to me they refer to telephone calls made to me, but, unfortunately they cannot find a recording of their call to me. I think they would find it difficult as mentioned my application was in writing not over the phone.

However, a slight dilemma. Having read Martin's interpretation of the period of time to claim back, i.e. 6 years, I have received a copy of one of my original application to MBNA dated July 1998 which quite clearly shows that I did not request card protection cover. I am awaiting the second application form as they took over a card from BOS.

Does anyone have an opinion that morally MBNA should be re-imbursing me from the receipt of my application for a credit card back in 1998 rather than the six year rule ?

Hi There - I wonder if anyone can help

Back in January I used a template letter from this site to request my paperwork to find out how much the PPI on my loan/s was.
In Feb i got a reply saying along the lines of "we cannot safely conclude that you were sold the policy in line with your current needs.... a full refund with interest will be with you within 6-8 weeks"

Great i thought! I hadnt even asked for a refund yet, just the paperwork!

Nothing appeared! So after 20 weeks (start of August) I sent another letter saying i hadnt received anything. I got a standard offer letter back offering me £1,4044.

I was thrilled (obviously) but without them having sent me my paperwork i didnt know if this was a valid offer or not. So I wrote back saying I couldnt accept or reject the offer as i didnt have the paperwork.

They wrote again, 2 days later, with the details. But now im confused!

Basically, I took one loan around 2004 and in 2006 I took another one, at a better rate but still with HFC to pay off the original loan.
Then in 2008 I was made redundant and used the reduncy monty to pay off the loan in full.

The offer that they made to me of £1,4044 was detailed to say that it was based on the several payments i had made on the 2004 loan, and then the several payments i had made on the 2006 loan.

(Is this making sense to anyone?)

So because i paid them both off early does that mean i am still entitled to claim back the full amount of PPI added to both loans?

Is there anywhere I can go to sit down and go through the paperwork with someone, independant of HFC, so I know how much to actually put in the letter when i write back? The amounts on the loan agreements are so confusing!

Any help would be appreciated!

    Thanks
    Sharon - deeply confused!

You could try your local citizens advice bureau and see if they have someone there who could help. Also if all loans were paid up you should get all the PPI back plus associated interest minus any rebate given when the loans were paid back early.

If the FOS found that MBNA had mis sold you this they would be asked to pay back from the start of the policy.

What a day! As some of you are aware my OH has been off work for a few months now and during this time we have missed a couple of repayments to Picture. Despite us missing the two repayments we have not received any letters from Picture which we were surprised about !
This morning a representative from Target loans turned up unanounced on our doorstep asking what we intended to do about the missed repayments!! WE WERE NOT NOTIFIED that this was going to happen!!
My OH did not let him into the house and informed him that he was off work due to an operation and could not afford to make the full repayments on the loan whilst being off work. He also informed the rep that the PPI company had refused to pay up and the case had been refered to the FSCS and we were still awaiting a reply.
We have offered to make the normal monthly repayments plus an extra £25 starting from September when OH should be back at work. The rep stated he would have to take our offer back to the company to be assessed.
Has anyone else been in a similar situation? What is the likelyhood of our offer of repayment being accepted. I am now begining to worry. Any help please!!

I was feelig quite low about it all yesterday, that was until I spoke to the lady at FSCS.She did actually give me some hope, more than anybody else I have spoken to in the past. She said they are making good progress.

I know it's hard but we have to somehow keep smiling:D:D:D:D:D

oh dear, i am not an expert on this but i dont think they can do this, i am sure they must give you notice, i dont know who you should complain to, i hope someone will come on here and tell you what you should do next, if anyone calls again tell them you will not be talking to them and they must contact you in writing, and shut the door on them, thats what i would do and also tell them if they come onto your property again you will have them for trespass, as you would be entitled to do

This is what I thought. My OH said the rep was not unpleasant, however he did not leave any information with his name or contact number on but did show ID of where he was from and was aware of information re our account etc.
Has anyone else experienced anything like this. I would be everso grateful for any thoughts on this. x

    Hi beaniebabe
Never heard of that before. I am sure the first step is to write to you asking for an explanation- regarding the missed payments and giving you the opportunity to make some arrangements regarding this with them. I am sure they have overstepped the mark by calling on you unannounced.I would call the CAB for advise on this one.
