Looks like we still have a way to go fingers crossed not too long though. We all need this sorted for sanity sake and hopefully they will be able to pay off some of their debts, and maybe a little treat

Hi there
I would write to them about your complaint, with your reasons of what you have.
Just like complaining of mis sold ppi, you can still complain on this issue if your not happy with the situation, just tell them you want this put right, and if they do not resolve this, you will take your complaint to the ombudsman, give them the usual 8 weeks.
May I ask if you have tried making a further claim?
And the reason for dispute, so we know where to take this hun?
Cheers.;)0 -
I have sent the template letter to Santander Cards ex GE Money stating that they were fined and that when I took out the PPI it was sold to me by what looked like a weekend worker (maybe student) thus could not have any financial background.
There reply in a nutshell:- My PPI was taken out on 5 November 2003 in store (They sent a copy of the agreement an "X" was written down by the sales person next to where I should sign - thus I didn't actually read what I signed - stupid I know) The X's ere at "Protect your Payment" and "The Credit Agreement"
- They state that the fine they received was for policies sold after 14 January 2005 when FSA's ICOB regulations came into force - my policy was taken out on 5 November 2003 thus the FSA's decision is not relevant.
- I signed for the PPI (next to the X) and I had an opportunity to change my mind - a 30day no quibble guarantee
- the best by far and I quote "In relation to your reference to the sales process in store, there was no requirement upon us to record the sales process and so we have no way of knowing what took place on 5 November 2003.
- The insurance has been clearly shown on statements
- They find no evidence of mis-selling thus no refund
- I can write to the FSA and because the policy was purchased in 2003 the FOS has no jurisdiction.
Do I have a case and where do I go from here?
Masmit, you mentioned solicitors, do you have a name of anyone I can use or has anybody else used a solicitor service to satisfactory conclusion.
I thank you all in advance, but the letter I received from Santander just smacked of "well, you are out of luck since it was 2003, although we tricked you into signing"
Regards,

fbredenkamp, have you tried the FOS over this at all? I would give them a call and explain this just in case.....0

Hello,
I'm brand new to this site and hopefully I'm on the correct thread. I've had a number of Loans/CC's/Store cards over the years and by scanning the forums I, like a lot of people, also had PPI. Whilst applying for these through various lenders, I was on many occasions 'advised' and given numerous reasons why I needed to take out PPI with them. Off the top of my head, I was told that if I didn't take out PPI with them I would for example be:
(a) less likely to be accepted
(b) would be given a far less competitive interest rate/APR etc.
(c) would slow down the application process
I still have a number of borrowings with some of these lenders and although I cancelled the PPI's a couple of years or so ago (after taking advice from a colleague and now good friend who used to work in a bank) I wondered whether trying to reclaim some of this back had a negative impact on my credit rating? I've always ran my accounts very well - I don't miss or make late payments, I stay within limits etc. but I wondered whether in light of the numerous compensations/refunds/payments being described on this site, if anyone had experienced banks/lenders etc. making life difficult for claimants of PPI by reducing credit limits/suspending or closing accounts/requesting immediate settlements? I know that they can do this anyway, but has it 'conveniently' happened to PPI claimants who claim from lenders that they still have an account with?
Any help would be most appreciated.0 -

I received the letter tonight, and I was wondering if anybody knew about claiming before 2005 as they stated the FOS rules didn't apply them. I will give them a call in the morning and find out though. thanks for the suggestion0 -

Hi all,
First time posting for me! Rang FOS two days ago to make sure my PPI claim had'nt got lost/forgotten about....anyway, had a call yesterday from an adjudicator who has just been assigned to my case. He asked a couple of questions but obviously could not say how much longer the process would take. My question is; if everything is straightforward am I looking at weeks rather than months now until this is concluded?0 -
hi again the reason for the dispite was we took loan out for 36 months ,i had ppi fell ill we claimed 3 months but while we waited on claim we missed two payments after that i got worried the guy came see me told me not worry as i pay 2 months after 3 year period ,this seemed fine but noticed that i had paid 23 months they said ive pay another 27 i said why they said all intrest got added on when u missed it and was ill said no way so went to CAB they said it wasnt rite as i had allready paid intrest in full which was added on top of loan ,they kept argueing with CAB this been going on 2 years im totaly fed up now but think im gona try sort it out myself but dont no were to start? cheers
Hi hun
Sorry I have not got back to you earlier.
I would have another word with your CAB and ask them to help you with a letter of complaint, it is still a complaint in regards of PPI, so ask the CAB to help out a letter together, give them 8 weeks and if they do not resolve this matter for you, I would definately complain to the Financial ombudsman service (FOS).
1. Revisit CAB (as they agreed something was not right)
2. Tell them you want to complain.
3. Ask them to help put a letter together for you, and make sure they write in 8 weeks, or you will take your complaint to the Financial ombudsman service (FOS).
4. Post by recorded delivery
If you hear nothing at all by the 8 weeks, then do not wait any longer but continue to the FOS.

I think this would be your best option here, as you have already been in touch with the CAB, give it a go hun and please keep us posted, good luck.;)The one and only "Dizzy Di"0
