    Just started editing the template letter out now, I think that I have been mis-sold big time ad will be forwarding off the recorded letter later today!!

    Hi Moneysavers,

    My apologies if this has been answered previously, I have browsed through but due to quantity of replies it's giving me a headache.

    I took a HPI agreement out through a Yes car credit branch in Oxford back in 2002. It was a 5 year agreement which was completed in 2007.

    I was sold (mis sold) PPI with this policy by a sales person who made very little/no reference to the policy and made it seem that it was just part of the overall agreement and to be fair I was 22 and just wanted the keys (foolish i know but hey I was young).

    I have absolutely no paperwork relating to this loan anymore.

    Now I have read back the above to myself it seems very unlikely I could claim anything back.

    Perhaps someone would be kind enough to offer me some advice as im lost :confused:

    Hello there

    There is no harm in trying.

    However, if you no paperwork, do you have the Agreement for this at all?
    If you do not have this any longer, try requesting for this to see if they can still supply this to you.
    Write to them to request for a true copy of the CCA (agreement), and enclose a £1 postal order or cheque payment for this, they should post by 12 days, post by recorded delivery.

    It may be that you will be lucky enough for them to send you this, but other than that, for even more information, you can request a Subject access Request known as a SAR, they should send everything requested on a SAR going back as far as 6 years, so if this was settled in 2007, there should still be information help on you.
    They have 40 days to comply with a SAR, but a payment of £10 cheque or postal order is required for this request, again post by recorded delivery, template link here:

    There are also template letters on the link, they have 8 weeks to respond in full, remember to add your own reasons for mis selling, and keep at them until you receive the final response, if they have not resolved in your favour, they should also enclose details of the Financial ombudsman service (FOS) who you can take your complaint to them to investigate, if eligible.

    The governance and accountability of the Financial Ombudsman Service (FOS) will be reviewed and the Retail Financial Services Forum will examine how issues affecting large numbers of consumers (the "wider implications process"), such as payment protection insurance, could be better handled. This could include updating regulators' powers to deliver collective redress.

    I have 2 PPI claims all being dealt with by FOS could do with a win. I also have 1 PPI claim with FSCS because company gone bankrupt.
    I have claim for bank charges on-hold for 3year

    hi could some one advise me on what we may be getting back on a capital one credit card for ppi. we took the card out in 1998 and we payed payment protection on it, i cannot remember how much. we spent up to the limit on it and then paid it all off after a while. we then, as you do, bumped it right up again to the 2000.00 limit and were paying the ppi on it each month. my husband fell ill and was off work for over a year but they refused to pay out saying that as my husband was not psycotic and just suffering from mental health issues they did not cover this. we had never been told of any restrictions when we took ou the policy and this is what i was contesting. we have still got the card open but we ended up paying off the 2000.00 after a year. we never recieved one payment from them for the ppi and when i was told they would not pay out on the claim i cancelled the ppi. we sent the letter to capital one and then another one and then went to the fos. we have had the claim in for over 18 months. i have recieved a message on the phone sayin that capital one are up holding our complaint but there was an error on the paperwork they sent back to the fos and the fos are waiting on a reply and will then send us a proposel offer letter. does any one know what we could be looking at getting back?
    any help would be appreciated

    Hi there;)

    You should receive all the PPI back plus interest, and the FOS normally request that they also pay out 8% interest of what a court would award on top.

    You could actually ask the FOS if they are able to provide you with the figures on this, the calculations then, but for more information, Maxdp posted in another link in how the FOS calculate PPI refunds, this may be of some help to you, good luck, and the link is here:

    Chin up jadest, I'm sure it'll work out in the end ;)

    It is really frustrating speaking from experience as I'm battling with Barclays who are saying to me they can't find my loan info and asked for the loan account numbers. I've already submitted my SAR request and received only the bank charge information which I communicated over the phone (one of them asked what is a SAR?) was speaking to their manager within minutes :p

    Another customer relations person actually gave me the details of one loan, so I know they're lying and trying to stall the claim. Threatened them with the information commisioner, if they didn't get this information to me within the next two weeks and true to form a letter dropped through the door today apologising and with the name of one of the data protection people, who I am now going to deal with directly.

    Best of luck and I hope it doesn't take much longer!
