marshallka wrote: »Well, my unfair rebate complaint has been squashed in a way now as the FOS have told me (a manager there) that I will no doubt not win with it as it has been reviewed by someone there.
It has been there since May last year, before two adjudicators against the lender and then it was FOS that told me that unfair rebates of PPI need to be against the insurer and that it was under "compulsory jurisdicition". They wrote on my behalf in October. The insurer asked for 4 more weeks but I submitted it to FOS and have been checking weekly ever since and now after all this time I have been told this. I was supposed to have a call yesterday about it from this manager but he never did and then today also but nothing as to yet. I am more annoyed at the fact that I had my hopes up for a third time as this would have been a couple of grand and now nothing. Tiggrae advised me to go for this complaint against the lender but FOS said "no" its the insurer and I thought that unfair rebates WERE a complaint but seems not in my case. I really want an explanation to this as I am totally confused.
Blimey Marshallka
So your still waiting??
You have been messed about rotten with this and I still remember when you submitted this again last year.
I was fed up with dealing with mine with the FOS, back and forth, so did not end up taking it back, but I know with yours it is quite a bit of money there.
We could do with Singlep back on here couldn't we?The one and only "Dizzy Di"0 -

Im not counting any chickens until i have the cheque in my hand lmao. All this talk of them going bust still worries me. If you think about it say 1000 of the 1400 complaints are upheld that could potentially be tens of thousands of pounds maybe more. Mines easily 3-4k i thinkMY Successes = RBS PPI, RBS bank charges, Aqua PPI, Aqua cc charges, HFC PPI, Welcome Finance PPI, Blackhorse PPI Mums Ongoing= Swift Advances PPI, London Scottish PPI, Blackhorse chgs, GE money pyts missing

Really sorry about your complaint Marshallka, especially as they don't seem to have given you any reason why not.
Di I don't think you will be waiting too long now if the FSCS has now worked out how to deal with the mis selling of PPI.

We have received a letter from FP today about our mis-selling claim ... they have reviewed it again and are satisfied that the PPI was explained correctly. "Nevertheless, having considered your complaint, the senior managers of Firstplus are willing to reach an agreement with you in an attempt to reach a mutually agreeable outcome. We are concerned that you are unhappy with the remaining cover provided by the insurance policy and should you wish to cancel the policy we would like to offer an enhanced rebate of the insurance premium. The enhanced rebate that we are prepared to offer you is calculated on a pro-rate basis of 78% of the insurance premium. Our offer takes into account the time the policy has provided you with cover (35 months) and the rebate is calculated on the unexpired term remaining (25 months). This would mean an amount of £2,721.57 would be applied to your loan account in addition to the normal rebate of £601.41 payable on cancellation of the policy.I would point out that this additional refund is made with no admission of liability by either the insurers or Firstplus and is purely a gesture of goodwill. I would be grateful of you would confirm acceptance of this offer in writing at your earliest convenience."This is their final response. We have already paid approx £3,500 and if we still have to pay till the end of the loan term that will be a total of around £16,500. If we cancel we cannot claim the £10,250 refund of premiums at 5 years as originally promised and they make no mention of a reduction in our monthly repayments for the rest of the loan. Our question is has anybody else received a response like this and did you accept it?? If not has the FOS found on your behalf??? Is there anything obvious that I have missed?? My brain is in a whirl with all this info!! Thanks.
Have just spoken to FP .... our monthly repayments will only drop by £38 for the remainder of the loan term.0 -
