It has been there since May last year, before two adjudicators against the lender and then it was FOS that told me that unfair rebates of PPI need to be against the insurer and that it was under "compulsory jurisdicition". They wrote on my behalf in October. The insurer asked for 4 more weeks but I submitted it to FOS and have been checking weekly ever since and now after all this time I have been told this. I was supposed to have a call yesterday about it from this manager but he never did and then today also but nothing as to yet. I am more annoyed at the fact that I had my hopes up for a third time as this would have been a couple of grand and now nothing. Tiggrae advised me to go for this complaint against the lender but FOS said "no" its the insurer and I thought that unfair rebates WERE a complaint but seems not in my case. I really want an explanation to this as I am totally confused.
Sorry to hear Marshallka. You must be at your wits end with this now it has been going on for ages and you are being pushed from pillar to post. Can you clarify above. Are you saying that the PPI would be against the lender as the people who sold the insurance. but if you are going for unfair rebate then it is against the insurer. Is that where rule of 78 comes in:mad:0 -

Maxdp, its not for misselling here. Its just the rebate received when we settled the account early (not the rule 78 on the loan but used on the PPI too). I will post up later. I just wanted this couple of grand and have done all I can now to get it. I am exhausted with it now.0 -

I was advised that this complaint needed to go to the insurer and FOS wrote to them on my behalf. I then got my responses from them asking for another 4 weeks in December but I let FOS have it and kept ringing to enquire with them. I was told on Tuesday that this complaint had been reviewed by a manager for the rebate and they were pretty sure I would not win. I then asked to speak to a manager who told me he would take my file home and get back to me but as yet he has not. I rang yesterday and today and nothing so maybe no news is good news. I was kind of banking on this one for the couple of grand but looks like its a no go. Will post up if I hear anything else as this was sort of a test case that I wanted to get FOS to look at to maybe help others in similar circumstances. (and yes it was rule 78 used in rebates). I actually found a case clipping either on law.com or motely fool where it stated that FOS would look at this as unfair penalty when used on PPI and would also include the interest when advising the business to do a pro rata rebate which was fairer. It works out a couple of grand and then statutory interest so would have really helped right now.

I have eventually got my refinanced loans from Barclays being considered by Ombudsman. They have now sorted out calculations for refinanced loans so am waiting to hear.:mad:0 -
hi everyone
please could someone advise me on the following. in 2007 i bought a car on HP. my credit wasnt very good at the time and the company who i got the car from found me the finace. when i went to complete the paperwork i was told that due to my credit history the company offering the credit said i must take out a full payment protection plan AND a full waranty through the dealership. because of my situation i thought this must be standard procedure and thought no more about it... until today. i phoned the credit company and asked them if they would have said that and they said absolutely not. they said they would write me a email stating this fact. i dont know how much extra it is costing me as im at work but i am fumming that a large company can opperate like this. could someone advise on how i should proceed as i feel like driving my car through the showroom window at the moment!!
any advice would be great.

Probably best not to do that:o If they told you you had to have the PPI and it was front loaded then that was miss sold. Send them a letter setting out exactly why you are complaining send by recorded delivery and give them 8 weeks to reply. Then post again and somebody will advise you. Good Luck:mad:0 -
thanks maxdp i will do that now.:T i wont ruin their showroom i like my car too much!0

Yes I remember now it was the rebate received. Well it is not over yet as they may well be still looking into this. It would be good to get some final say from them on this. It is frustrating when you do not hear back but look on it as good news because it has not been declined yet.

What has happened on the other web site, you know the one, they used to post on here a lot to get business for a class action. Was that about unfair rebates? Have not kept up with it cause was not a company I had dealt with.:mad:0 -

My complaint can only get to FOS via the insurer and that is for DEFINATE. It all a bit vague at the moment but things could materialise for others too. If I have to give up then so be it but at least I tried and more to the point at least they are listening to me. Thats all I want, a fair hearing.0 -
marshallka wrote: »I have gone about this another way maxdp. I don't go on the other one as there are lots of ways to go. I have seen someone post on here today about a radio interview today about FP. The website is mainly about the interest rates and it not being related to the BOE base rate etc/ libor rates etc but does include misselling issues too. Its also about the loan conditions too I think.

OK had not kept up with the other web site so was not sure what they were doing really
Well fingers crossed it gets sorted soon. Nobody can say you have not tried every which way with this one.:mad:0
