PPI Reclaiming Discussion part 4

Hi there;)
There is a success thread next to this one, when you have time, take a look on there.
There have been much success with BH, although I am aware they are not always easy, best to keep on at them, I take it you have a case with these?
If so have you started the process of reclaiming yet?
Hi there thanks for your reply!!
I'll give you the history first! I currently have a fixed sum loan(£8000)(120 monthly payments,18.9 APR) with them at the moment.I've been paying it off now for 2 years. At the time of applying we really needed the loan and not many people were willing to give us one because of our credit rating! So they offered us one without explaining anything to to with PPI etc.So we just went for it!
So now we get a letter saying that they MUST tell us from now how much we are paying in a yearly statement. I looked at the statement and was staggered by how little we are actually paying off on the loan! I pay £268.54 each month to BH but i found out that £179.19 of that is in interest alone! Then i read all the small print about PPI and was also staggered as to how much it is! PPI = total amount + interest is £9207.60..... thats just for the PPI on a £8000 loan
So i need help as to weather i qualify to reclaim as i still have the existing loan aggreement???? Thanks p.s if you need more info from me then i'll give it!!:beer:0 -

The annoying thing about this ppi and bank charges reclaiming is do the government not understand that by paying back this money it will get people spending and help the economy.0 -

You carry on to the FOS. I see the boys at Hardman Boulevard are still trying this on still. Send the case to the FOS - the first letter you'll get off the FOS will state that they've received your complaint. The FOS will then conduct due dilligence and make sure that you have got a final response and that you've given them chance to settle the complaint etc. It's the next letter things will get interesting. The FOS will then write to you stating they are requesting info from RBS/Nat West etc. Once RBS see this - they'll want to settle with you 'as a gesture of goodwill' but they will settle in full.
If you really want to put the cat amongst the pidgeons - have a look at the final response they've sent you and see if it states they have reviewed the original credit agreement as part of their investigation. If it doesn't it means they haven't got it - send em a Section 77 request under the CCA - they won't like that as RBS have lost loads of credit agreements and they'll hate to have to admit to you that the loan is unenforceable as well.
Good Luck,
TBD.
Firstly I would like to say sorry for the delay in thanking you for that, as you can see I have a slightly different name, I was having problems logging in and even requesting a new password was hell
Anyways
I have sent off my FOS complaint last week and I haven't heard anything as yet, something like a letter saying that we have your complaint and it is being dealt with would be nice, does anyone know what the timescales is here to recieve this confirmation letter?
I will keep you all up to date on how I am getting on and lets hope I don't have anymore problems logging on

Hi again, wonder if anyone can help me?
We had our final response from Norton saying saying no to our claim for PPI, we then reported them to the FOS a few months ago. Today the FOS have written to us stating that as Norton were not members of the FOS or GISC when we took out the loan there is nothing they can do. Reported to FLA and they cant help either. Do we have any other options?0 -

Hi Jessie
Sorry to hear that, it's so damn annoying that isn't it?
This have happened to many on here.
So the FOS are unable to look at your case either then because the business were not regulated by either of these regulators?
Yet some have posted to say that the FOS have asked them to resubmit their cases to them so they can take another look, have not heard anymore on that matter though.
Hopefully someone will come up with a suggestion on this for you, but have you tried taking this to your local CAB and see if they can help with this, I think they have a free solicitor on certain days, check with the CAB and see what they have to say, its just another option.
You could take to small claims court if you want to, but as you know they cost, but please do be careful on these claims management companies as well.
Its well worth getting some advice on this.
For more information, if you do want to just take a look, here is some on small claims courts here:

I do not know much about his this works though and with a bit of luck someone who have been this direction will post up with some advice and help for you, good luck and please keep us posted.;)The one and only "Dizzy Di"0 -
Hi di3004, It all seems so unfair, we have so many grounds for winning this case and the PPI cost us £4700 on an uprfront premium, and thats alot of money to us I can tell you!0
