So glad for you pinknico about Picture. You must have been tearing your hair out. Lets hope its all settled then fairly quickly and you have a great summer holiday.

Thanks Marshallka, it has been a frustrating time. Have you heard anything about your claim with the FOS?

    Pinknco,
Niether.....The FSCS have outsourced the Picture cases to Deliotte to avoid any more delays.

They are a commercial outfit and will be far more efficeint than the FSCS at dealing with cases.

Given the staus of Single Premium PPI's within the financial world I'd be surprised if there are any nasty surprises. I don't think any of us were made aware of what Single Premium PPI actually was!

    Let's wait and see..

Just been looking at the FSCS and it seems that they run similar to the FOS in that they do look into claims about firms that went under prior to the FSA and they apply the relevent schemes like FOS do. It says

    9. What happens if the firm I am claiming against was insolvent or declared in default before FSCS took over responsibility for compensation (1 December 2001)?

The rules and compensation limits of the pre-existing schemes will apply, although FSCS will handle the claim. Compensation limits and eligibility rules may differ.

    It also says here

    6. How long will it take to process my claim?

After a declaration of default, FSCS aims to process all claims within six months. However, the time this takes depends very much on the type of claim. For example, most credit union claims can be completed within four weeks. For other types of claim it may take longer, depending on how complex it is and on some factors that may be outside of our control, such as waiting for information from third parties

    Marshallka,
In the email they also attached a copy a letter sent to my MP in which they state all cases will be concluded by Jan 2010.

My guess is that the FSCS have had their butt's kicked and told to speed things up...They have pushed back and have eventually been allowed to outsource some of their workload..

I'm under no illusion that this will be sorted tomorrow but at least the goalposts have stopped moving!:T

    Hi there all,

I'm trying to reclaim PPI from Lloyds TSB on behalf of my mother in law.

Basically i've said that as she was a housewife at the time she took out the policy (and still is) and had pre-exisiting medical conditions, then the policy was missold on the grounds that:

    1. No Lloyds TSB staff asked her about her employment status at the time.
    2. No Lloyds TSB staff asked her about her about existing medical conditions at the time.
    3. No Lloyds TSB staff gave her full information on what the policy would/would not cover.

Eventually they have replied and basically said that their staff did give her full details about the policy and that she signed the form agreeing to this, which she has but is adamant she wasn't told about the policy and would not have taken it if she knew about it. As such they have denied her claim.

As she has signed this form does that basically mean that she has no case, or is this a standard reply from them in a bid to deter her from taking the matter further?

    Hi there

This is lloyds all over, keep at them.

I was also sold PPI with a credit card in 2001 being a home person, its just a standard response, and if they say "you are covered for job solutions, life cover etc" this is just standard.

If this was the first response, then write back to them, they should take another look and in the final decision they should give details of the financial ombudsman service (FOS), mine was e eventually resolved through the FOS.

The FOS says as I was not covered with all the benefits that lloyds tsb offers with the PPI, it was worthless to me anyway, so keep at them.

Good luck and please let us know how your mum gets on.;)

Hi There. Firstly well done for that. There hve been reports of waiting up until 3 months on here. I have waited over a year for Barclaycard to pay me all that was owed to me. (It is now with the Ombudsman for final decision). What you can do is ring them up and ask when they will pay it. If you get no reasonable response with that then go back the the FOS Adjudicator who has been dealing with your case.

FOS usually like you to communicate with EGG firstly though. Good Luck

    Thanks Max.

Just phoned Egg (on hold for 25 minutes) and there is nobody dealing with the calculation, nor will they offer any time scale for what they intend to do. And yet again never an apology, only more thanks for waiting. I told the drip at the end of the phone I was going to peruse my money through the county court and that this should be noted on my file. To follow this up I've just sent the letter below. I have no idea if it's in all actuality enforceable, but it must be better than doing nothing for the moment. Any how, should be interesting to see what response I get now, though my strong suspicion is that it'll be steely silence...again... any how see what you think:

    NOTICE OF LAW PROCESS 10/07/2009

    Ms XXXXXXXXX
    Egg Customer Relations Office
    Riverside Road
    Pride Park
    Derby
    DE99 3GG

Dear XXXXX or other representative of Egg Bank PLC,

Further to my conversation with your representative XXX (employee number XXXXX) I would like to state my frustration and bewilderment at the extent in delay of settling my claim. As you know, this has been upheld in my favour by the ombudsman and you are required to make full settlement to me.

You have now had the ombudsman’s decision since May 15th and confirmation of my acceptance from the ombudsman on June 9th. I believe that you have had more than sufficient time to calculate the refund due and further delay is unacceptable.

I believe that I have now exhausted all other options available to me due to the fact that even after this amount of time there is no one person able to deal with my settlement, and I can gain no offer of time scale from any other representative of Egg Bank PLC.

To this end, as I advised XXX, if I have not had full and acceptable settlement and payment within 14 days of the date of this letter, NOTICE IS HEREBY GIVEN that AN ACTION AT LAW through county court will be commenced for the recovery of the said sum (calculated in accordance with the obudsman’s advice) due from Egg Bank PLC to myself together WITH ALL EXPENSES CONNECTED THEREWITH.

It is hoped you will deem it prudent to pay within the time specified and avoid the expenses to which you will other wise be liable.

I would also like to offer you some advice. When you have been found guilty of acting in an illegal fashion and conning people out of money, instead of thanking them for their patience over 18 months you should offer a full and frank apology. It’s simple common courtesy which seems to evade your customer relations department.

NO FURTHER NOTICE WILL BE INSTITUTED

    Yours....
