    I know it can be so annoying knowing its still in the pile waiting to get looked at, well lets hope as soon as they are on to them, they will get this done very quickly for you.
    I take it the 24th is the deadline they have then?

    Your not being a pest to them hun, you only want an update to know if they are dealing with your case yet, that is natural, I know it's a waiting game, hopefully though it will go in your favour anyway, good luck.;)

    Thank you for your emails dated 17 June 2009 and 30 June 2009 about your claim for compensation against Picture Financial Services Plc (“Picture”).

    I can confirm that your MP, James Arbuthnot, has contacted us about this matter. I am enclosing a copy of our reply to him. That letter notes that Picture was declared “in default” on 8 July 2009, and explains the reasons why we were not in a position to issue the default declaration at an earlier date.

    In your email of 30 June 2009 you have suggested that the Financial Services Compensation Scheme (FSCS) may have investigated areas which have previously been reviewed by the Financial Ombudsman Service (FOS). However, as our email of 26 May 2009 explained, when establishing the criteria to consider Payment Protection Insurance (PPI) claims, we have worked closely with others in the regulatory sector, including the Financial Services Authority (FSA) and the FOS, to avoid any duplication of work. However, we must assess claims in line with our rules, as made by the FSA, and our policies, as agreed by our Board of Directors. FSCS operates under a different set of rules to FOS, which means there can be differences in the approach taken between the two organisations.

    As a default declaration has been issued against Picture, we are now in a position to consider whether your claim for compensation is eligible for compensation under our rules. If your claim is eligible, we will calculate what loss, if any, you have incurred as a result of the advice you received from Picture.

    In this respect, we have taken steps to ensure that we provide as prompt and efficient service as possible to investors, and have sought additional resources to enable us to do this. We have therefore outsourced selected claims, including yours, to Deloittes who are assisting us with the assessment of Picture claims.

    Although I am unable to give you an exact timescale for your claim to be completed, as you can see we are making progress in this matter. Please be assured that we will send you our decision on your claim as soon as we can.

    Wonder when they will update their web page? Hope everyone wins their claims, still a bit worried about the FSCS rules not being the same as FOS.

    Got so excited by Gumbi's news that I forgot to post that Egg has not replied by the 9/7/09 so it has gone to the Ombudsman. More waiting! Really surprised Egg are allowed to continue to act like this without getting reprimanded for time wasting etc.
    Never mind the Ombudsman is legally binding and Egg will have to pay up eventually.

    So glad for you pinknico about Picture. You must have been tearing your hair out. Lets hope its all settled then fairly quickly and you have a great summer holiday.

    HI, DOES ANY ONE KNOW,IF THERE IS A LOAN OUTSTANDING WITH PICTURE,IF YOU WIN YOUR CLAIM,DO THEY TAKE THE BALANCE OF THE LOAN?

    I would say that all you have paid to date be paid to you by cheque as you have been deprived of the money to do with as you please and also 8% statutory interest added to this and then the amount of PPI and interest that you owe would be taken from the balance of the loan reducing your repayments.
  • Hi there all,

    I'm trying to reclaim PPI from Lloyds TSB on behalf of my mother in law.

    Basically i've said that as she was a housewife at the time she took out the policy (and still is) and had pre-exisiting medical conditions, then the policy was missold on the grounds that:

    1. No Lloyds TSB staff asked her about her employment status at the time.
    2. No Lloyds TSB staff asked her about her about existing medical conditions at the time.
    3. No Lloyds TSB staff gave her full information on what the policy would/would not cover.

    Eventually they have replied and basically said that their staff did give her full details about the policy and that she signed the form agreeing to this, which she has but is adamant she wasn't told about the policy and would not have taken it if she knew about it. As such they have denied her claim.

    As she has signed this form does that basically mean that she has no case, or is this a standard reply from them in a bid to deter her from taking the matter further?

    Lian,
    I'm not 100% certain but I'm fairly sure that as this is now out of Picture's hands the FSCS would send any compensation directly to us if we are due any.

    Perhaps somebody with more knowledge than me could confirm.

    My thinking is that I've been told over & over that Picture don't exist any more and this is why the case went to the FSCS as they would not be able to meet any claims against them.

    The FSCS is a government body so if and when we do get our money back it will be from HM government (DEEP JOY!!!!)
