Thank you for your emails dated 17 June 2009 and 30 June 2009 about your claim for compensation against Picture Financial Services Plc (“Picture”).
I am sorry that you are unhappy with the way your claim has been handled to date, and that you consider there have been unreasonable delays regarding the investigation into Picture.
I can confirm that your MP, James Arbuthnot, has contacted us about this matter. I am enclosing a copy of our reply to him. That letter notes that Picture was declared “in default” on 8 July 2009, and explains the reasons why we were not in a position to issue the default declaration at an earlier date.
In your email of 30 June 2009 you have suggested that the Financial Services Compensation Scheme (FSCS) may have investigated areas which have previously been reviewed by the Financial Ombudsman Service (FOS). However, as our email of 26 May 2009 explained, when establishing the criteria to consider Payment Protection Insurance (PPI) claims, we have worked closely with others in the regulatory sector, including the Financial Services Authority (FSA) and the FOS, to avoid any duplication of work. However, we must assess claims in line with our rules, as made by the FSA, and our policies, as agreed by our Board of Directors. FSCS operates under a different set of rules to FOS, which means there can be differences in the approach taken between the two organisations.
As a default declaration has been issued against Picture, we are now in a position to consider whether your claim for compensation is eligible for compensation under our rules. If your claim is eligible, we will calculate what loss, if any, you have incurred as a result of the advice you received from Picture.
In this respect, we have taken steps to ensure that we provide as prompt and efficient service as possible to investors, and have sought additional resources to enable us to do this. We have therefore outsourced selected claims, including yours, to Deloittes who are assisting us with the assessment of Picture claims.
Although I am unable to give you an exact timescale for your claim to be completed, as you can see we are making progress in this matter. Please be assured that we will send you our decision on your claim as soon as we can.

Well I do hope this gets sorted out.
If your not happy with the way its being dealt with ask if there is a way you can withdraw your case, and you will deal with this matter yourself, we can help you in regards of ppi if you were mis sold for any reason.
Obviously I would make sure you would not have to pay out as well with your ex boss.
I don't actually know how it works, because of dealing with these myself with help from on here and other sites, with free templates etc, if you want to go this direction, we can try to help, it will just be a case of paying out for a few stamps and if your successful the whole lot of refund will be yours.;)

Aw thanks. It takes me a while to get back to people as my pc access is a bit random. Ive received a letter now from my boss stating that the sols for NR are saying that Im 'mistaken' and I must've taken the loan/ppi out through a third party because NR have no record of the phone call!!! :mad:
I assume this is just a standard 'try on'? My court has also changed from Harrogate (which I couldnt attend if I had to due to the distance) to Stockport (which is my home court). Does this mean I will have to attend if asked? I've only been in court before for a car bump and it was the worst experience I've ever had.

In regards of the court, I am not too sure about to be honest, with not even been in this position, but if you cannot make it, let the business know, not unless you can have someone to represent you, I would ask on this, and of course that's if you do need to be there.;)The one and only "Dizzy Di"0 -
Hi to all you wonderful people who have given so much good advice Finally we have a result!!! About bloody time too sorry but even though it has finally come what do we do now? Do we carry on and try to save our home or will it be too late? If it could be six months before we recive our money we cannot wait that long or we will lose our council house. Any ideas guys would be greatly welcome. We don not want to move out but I cnat see it being over within our timescale for repossession and moving. Help please feeling really good that they have got their just deserves but very confused

Could you not ring the FSCS and let them know that you are facing repossession, they may fast track your claim. I would also let your MP know and see if they can do anything for you. Surely now they have been declared in default something can be done.
I know how angry and upset you must be but don't give up you are a fighter and we are all here for you.0 -
I would ring the FSCS on Monday and explain your situation and ask if they can in all honesty give you a timescale for when your claim will be looked at etc. Gumbi's MP was told ALL claims should be dealt with by Jan 2009 and that is over 600 odd claims so I would think that they are not expecting each claim to take 6 months. Still cant believe they could repossess if claim is now being looked at .

They are closed now, but 1st thing Monday give the FSCS a call on 0207 8927300 and explain your situation. They may be able to help.
I spoke to a very nice man today in response to a application form for compensation that I had received from them today.
Incidentally has any of the other Picture Protesters received this form from FSCS ?It asks many questions and requires in-depth filling out and explanation as to why you feel policy was mis sold.
The gentleman did confirm to me though that when they receive these forms back they are assessed and then handed to the outsourced company who will take up the reigns. Although he wouldnt actually give me specific time details in relation to turnaround but he did imply that it would not take a great deal of time as they now have a large amount of staff to deal with these claims not to mention the outsourced company.
So in short, there is light at the end of the tunnel and its getting brighter ...........If you see a penny, pick it up, all day long you'll have good luck !!!!!!0 -

I do really feel for you, I really can't imagine what its like for you, but have a lump in my throat over what your going through here.
Wish things could have been dealt with far earlier, it just isn't fair with what you have been through hunni.
I am finding it very difficult in finding the right words.....
