    I think I am doing right. :o I am sure that if I were to claim on the PPI and be successful then they would have a good argument against accepting it was mis sold. and I am not taking the chance. Once again Thanks for your good advice.:D

    Yes I sent the request for copies of the loan agreements via recorded delivery. I'll double check with the Royal Mail and then follow it up like you suggest.

    I've got just a few more days to give TPF til the 8 weeks are up and then I'll send off the FOS letter! Can't believe they've not sent anything back, even if it was a standard "get lost" letter!! ;) I'll let you know how I get on.

    I know what you mean, and besides to your knowledge due to the existing medical condition anyway they do not normally pay out, so good luck XX

    Hi Beatlefan,

    Have you got the number of the caseworker, you could possibly give them a ring.

    I kept pestering them every week, I also got in touch with the FOS and had my case number and forms ready when I was sent the final response.

    I would start pestering them now but be prepared for the NO letter.

    Have had Royal Bank Scotland mortgage since Dec 2004, at the time we took out mortgage PPI through another Co put in place by Mortgage Adviser. When I became pregnant and left my job in Feb 2006 to go on Maternity Leave, my employer did not 'top-up' my pay and I was only in receipt of SMP, a loss of about £1,400 per month!!!!!!!!!! When we approached PPI Co about a mortgage break they said, we couldn't as we hadn't had our mortgage in place for a set period of time (think it was 3 years), so we ended up in mortgage arrears until I could get back to work after the birth. As we had not been told this when we took the PPI out, can we reclaim? Just to add, as soon as they told us, we couldn't have the mortgage break we stopped paying the PPI - we just though why pay it for 3 years if you have no chance of claiming, the money could be better off used elsewhere.

    Any ideas

    I can't see why not.

    For more information on PPI reclaiming, check this link here, it has templates to help you through the reclaiming process, write in your own reasons, they have 8 weeks to respond in full.
    Another letter maybe required if they do not resolve this in your favour on the first response, they should give you details of the financial ombudsman service (FOS) if eligible and your not satisfied with the outcome of their final response.
