    Good luck Dialysis. It seems like you are doing the right thing although it proberbly doesn't feel that good at times. At the end of the day you have to consider your own health and look after each other. Looks like you have your priorities right. Take care. X ;)

    Cheers for the reply.

    My complaint is with Beneficial Finance (HFC) who I believe have already been in trouble with the FOS.

    I don't wish to restructure my loan with them, especially as they will put it on an additional APR. So they wont me to pay twice the APR which I'm just not willing to do, irrespective of the reduction due to the refunded PPI.

    I would like a repayment to myself via cheque or in my bank and just continue my repayments as they stand.

    They did say I could complain to FOS and included a leaflet with my letter, which was nice. :smiley:

    You think I should write back direct or just go through FOS now?

    if you get your loan restructured ( you have to because the ppi will have gone) you will get your loan over the remaining original loan term, with the same apr so it will finish at the same time as the original loan, unless you have arrears i would ask them to please reimburse the money to you, hope this helps

    i think if you make a claim you have used the ppi and it was fit for purpose, but i am not sure, someone who knows about this will be able to help you i am sure

    Sorry to hear of your hubby and hope he is doing okay and you of course.;)

    So in the policy it states that you would not be covered for a pre existing condition that your hubby had when taking this policy out and now they are stating you can make a claim?
    Did you get in touch with them in regards of this claim recently to ask?

    Sorry I am a little confused in what they are doing here.
    Have they officially made it clear that you can make a successful claim?

    Normally when a successful claim has been made, this is generally not seen as mis sold, as they take it your aware of what is what with the policy, however if you do have reason to complain on your policy you have the right to complain anyway.

    Hopefully someone will be along to give you more info on this one, good luck with all this, keeping my fingers crossed for you.;)

    sorry you are having such a tough time at the moment, please try and keep your spirits up, nothing is worth making yourself ill for, i hope that you get a resolution to your claim and you can pay your arrears off and keep your home , sending you a hug. good luck

    Thanks Amersall. I am reluctant to claim on the PPI. I think this is a crafty move on Pictures part. I do not think for a minute they will pay out as the operation was due to a pre existing condition and OH was in temporary employment. The policy was mis sold for definate so I am not going to be tempted and am going to stick it out. They are not getting a penny more from me!!;)

    Now in regards of the £1 request for your CCA they should have supplied this by 12 days.
    Did you check with online Royal mail tracking that they received this?
    I take it you posted it by recorded delivery?
    I would ring them to make sure on this one or ask the Information Commissioners Office (ICO) for some advice on this matter, maybe they will contact them on your behalf, no harm in asking, tell them you need this information to help you with a reclaiming case for as soon as possible and you even sent a payment, but heard nothing.

    In regards of PPI reclaiming, they have had their 8 weeks, I would move on to the FOS and if you hear from them in the meantime with a good outcome all the better.;)

    You can ring the FOS or download from their website for a complaints form here:

    Try to enclose copies of evidence to support your case and any copies of correspondence from the finance company, tell them you have not heard past the 8 weeks.

    It was picture who advised me to contact the insurance company. They said it was worth making an enquiry thats all. I explained that the PPI would not pay out and explained I beleived it to be mis sold and this was being investigated. Picture stated it would be worth contacting the insurance company to ask anyway. I have not done this yet as I do not want to lose out on the claim with the FSCS as I believe the policy was mis sold on several accounts.

    Your welcome hun, and I don't blame you, there are many reasons for being mis sold and it may be a mistake if suddenly they did not pay out for it on a claim, so you done the right thing me thinks.:D;)XX

    Yes I sent the request for copies of the loan agreements via recorded delivery. I'll double check with the Royal Mail and then follow it up like you suggest.

    I've got just a few more days to give TPF til the 8 weeks are up and then I'll send off the FOS letter! Can't believe they've not sent anything back, even if it was a standard "get lost" letter!! ;) I'll let you know how I get on.
