Hi everyone, a good few years ago(7) I applied for a £5,000.00 loan from Natwest to buy myself a new car.
Being only 18 I was made to take out the loan protection on it. Would I have a valid claim to get the money back as I never faulted on payment and settled the loan before the agreed settlement date

    Hi and welcome,

If you were mis sold this for any reason then yes, it does not matter if your policy is settled or still active.

More here on this link about about reclaiming and the guidelines:
    http://www.moneysavingexpert.com/reclaim/ppi-loan-insurance
You will also come across templates to help you through this in stages, use your own reasons though for why you believe you were mis sold, they have 8 weeks to respond in full.
Another letter maybe required if they have not resolved in your favour in the first response, they should let you know this, and also in the final letter they should give details of the financial ombudsman service (FOS) if eligible to go this direction if your not satisfied with the outcome.

    Post by recorded delivery.
Oh you write to the ones who arranged this, the broker then for example.;)
    Good luck.

    Hi
As you can see from above the Ajdudicator up-held my claim on 24th April. Loans.co.uk were given till the 14th May to reply to this and in true style they didn't. So then I emailed ajdudicator who said that if I had not heard any-thing within 2-4weeks to email again which I did. Only to find there there is now another backlog for the claim to now be passed to Ombudsman for final decission... so then I emailed again (a week ago) to ask how long the backlog was and how long approximately would I now have to wait for the final decission and guess what a week later and still no reply to my email so either I have very long wait and no-one wants to tell me the bad news or I have got on the ajdudicators nerves.

Do you think I should leave it or email again... I have already been waiting a year to get this far and think I am feeling very irritated and inpatient:confused::confused::confused:No wonder companies are refusing to pay... they know that the FOS are dragging there feet:confused::confused::confused::confused::confused::confused::confused::confused::confused::confused::confused::confused:

    Hi Jadest

How frustrating this is for you.....

So just to double check on this, your now waiting for this to me moved on to the ombudsman for them to investigate because loans.co.uk have not responded to the adjudicators decision?

I would try to contact the FOS again maybe by the end of the week, or every few days, maybe ring them for a quicker method, as they may say we are holding them back sort of thing......
Give them a call on the phone, this will be quicker and out of the way, good luck hun let us know what they say, cheers.;)

    Hi All,

Recently received letter from A&L re the above and have started the ball rolling.

Partner now wants to do the same for loan and credit card, but also has had quite a few bank charges in the past from the same provider.

Therefore, as his loan, credit card and bank account is with the same provider, and considering that the process for reclaiming bank charges is officially frozen, do you think it is still worth combining the three reclaiming letters into one? We would still like to lodge a complaint about the bank charges as soon as possible, even if they are not dealt with for some time.

Or will the freeze on the bank charges only delay the PPI insurance reclaim?

    Any advice welcome.

    Thanks :)

    Hi there

I don't know much about bank charges myself but I am sure someone will give some advice on this matter, but in regards of PPI, if your going to complain for being mis sold I would keep matters separately in my opinion.
As they are really 2 different complaints.

For reclaiming ppi on loans, credits cards, store cards etc etc link here:
    http://www.moneysavingexpert.com/reclaim/ppi-loan-insurance
check this link out to help you, there are templates as well, but write your own reasons they have 8 weeks to respond in full.
Same goes for charges on cards etc but you will find more info in regards of charges on this link here:
    http://forums.moneysavingexpert.com/forumdisplay.html?f=102

Personally I think you know where you are if you keep matters separately, good luck and please free to post for help when required, and hopefully someone will post up for further help for you.;)

Yes that is right the Adjudicator up-held my compliant after a year of my complaint being lodge with the FOS... I nievely thought that was it I would get my money at that stage, but no, now it has to go higher than the Adjudicator for final decission... and there is another queue... it is so frustraiting...

I will do as you said and phone as they are not answering emails.

    Thanks again

HI, We have received a letter from RBS stating the bank is prepared to refund the insurance premiums that we have paid to date as a gesture of goodwill. This excludes the amount automatically credited to your loan account of £425.76 when the policy was cancelled. (don't understand why this amount). Also paying back amounts we have already paid for the payment protection element of our loan. In addition to the refund, as our ppi as been cancelled, the outstanding balance of the element of your loan relating to the ppi premium will be paid off as if it never existed. (does this mean that the amount owing on the ppi will be taken off outstanding balance?) No mention of the 8%. anyone any ideas why the £425.76 amount. thanks!!!!

    Hello there
I would ask them to post you the "Full written breakdown of calculations" for this, so you can understand what is what and post them on here for someone to take a look if you want to, I don't understand when it comes to calculations sorry.
    Good one though.:T:beer:

I have a similar situation - RBS have offered just under £2K as 'goodwill' which looks to be about right for the payments, but no mention of the 8%.
They also said that it would be credited to my account.
    1) can i insist on a cheque, since the premium wasn't paid from my credit account? (be nice to get £2K off the balance but it's a matter of principle)
    2) should i push for the 8% as they've already earnt double that in interest on it over the years?

    Thanks :o

This is worrying! Is this normal, do most peoples get passed to the Ombudsman after the adjudicator?
My adjudicatior told me that my case was similar to others against Egg, and that this was causing it to take a slightly longer amount of time.
I have seen that Egg seem to have been in trouble quiet a lot with this. Do they usually pay up when the adjudicator says they should?
    Thanks.

    HI ALL

Please be aware if you are querying PPI or charges on an account; whilst that account is in query (whether internal procedure or the FOS) it is against the banking code (section 13 i think) for them to take any adverse action against you or file adverse information about you whilst the account is in query.....

Have you already had a CCJ actioned on you whilst you were waiting for an outcome on a PPI or charges query? You can apply to 'set aside the judgement' on the grounds the judgement was wrong, the amount will of course be wrong if it includes unlawful charges and miss sold PPI. Use the website http://www.hmcourts-service.gov.uk/ to guide you and download the formas you need. I am on with it now against Black horse i will keep you all updated........
