    Hi Sparky,

    Thats not Capital One's final response, and they deny any claim on the first letter. It always takes 3 hits to crack Capital One. What you now do is send them a letter before action and state to them that you're not happy with their response and you are requesting that they look into your complaint again - pop in a copy of your original complaint and send it off to them. They will then offer you 50% of the premiums. You then send them another letter stating you believe that you should have all the premiums back - then they'll pay.

    You carry on to the FOS. I see the boys at Hardman Boulevard are still trying this on still. Send the case to the FOS - the first letter you'll get off the FOS will state that they've received your complaint. The FOS will then conduct due dilligence and make sure that you have got a final response and that you've given them chance to settle the complaint etc. It's the next letter things will get interesting. The FOS will then write to you stating they are requesting info from RBS/Nat West etc. Once RBS see this - they'll want to settle with you 'as a gesture of goodwill' but they will settle in full.
    If you really want to put the cat amongst the pidgeons - have a look at the final response they've sent you and see if it states they have reviewed the original credit agreement as part of their investigation. If it doesn't it means they haven't got it - send em a Section 77 request under the CCA - they won't like that as RBS have lost loads of credit agreements and they'll hate to have to admit to you that the loan is unenforceable as well.

    Hi
    I used the templates 1 & 2 and sent them off to Egg. They responded saying that they did not uphold my complaint and that I could take it to the FOS. I did.
    This week the FOS adjudicator have sent me a copy of the letter they have sent to Egg requesting that they pay me my monies back. Plus interest and £200 for my stress, nearly £7,000. The letter is brilliant and includes loads of items I didn't actually complain about. It was 8 pages long! I was well impressed.
    What usually happens next? Am I likely to see the money?
    Also the adjuicator mentioned in my letter that I had PPI on my previous loans, which the final loan was a top up of and PPI was added on.
    Does this mean that they had already charged me a single premium for the previous loans and then again for the final one? If so is this something I can get the adjudicator to look into and could I be entitled to more? I and Egg have 1 week to give him any further facts.
    Can anyone help. I feel like I'm getting somewhere but not sure what will happen next.

    If I were you I would ring the adjudicator and ask him/her if they are able to look at the other loans as well if they haven't already done so.
    How were you mis sold? I am waiting for an adjudicator to make a decision on my complaint. Thanks.

  • don't be too hopefull that Abbey are as helpful as they pretend to be. They hold on to 'THE' money in question as long as possible giving various reasons as to why the cheque hasn't yet left their payments section. I have worked in accounts previously so i know all the delaying tricks and believe me so do Abbey!!!!

    Hi,

    My friend has received another letter yesterday from A and L. They say they are currently investigating her complaint and will issue her with a response within 28 days.
    In their leaflet they enclosed they say if she is not happy with their final response she can contact the FOS, but before that option becomes available it may be helpful to contact the FLA as they are members and are bound by their lending code.

    Should she contact the FLA before the FOS

    Really hard to advise on that as I hear that the FLA are not that great when it comes to complaints against their members. However they maybe quicker than the FOS and may find in your friends favour.
    Hopefully Aand L will find in her favour without having to go to either of them!
    Hope someone else can give you a more helpful response! xx

    I will tell her to wait for her final response and if it is not good I will tell her to contact the FOS.

    I was surprised when she showed me the letter and they said they would give her a response in 28 days. I thought it was a bit quick.

    I was paying a single lump sum premium and paid off the loan 4 years early.
    I think I had to wait about 4 months for the adjudicator to respond, it probably took him that long to write the letter!
    Good luck with yours. I'll let you know how I get on and the time scales.

    Stick with Abbey as they will pay up. They refunded me over £4k last year on a mis-sold PPI policy. It took 12 weeks but I got the cash
