    I have already done this and sent them copies of the agreement, I sent them a second letter yesterday by special delivery only to receive a nasty call saying that i havent proved that the salesman was pusy or that he forced me into the agreement. I recorded their call as well and have sent them another letter.


    Hi hun

    They should have done this in writing and not by ringing you really, as you have something to prove to the FOS, so if they have not resolved this for you by the 8 weeks from start to finish and you hear nothing more, then do move on to the FOS.
    I would ask them to send you a copy of all calls made by both as well, they should have the most recent ones even if they don't from when you taken the policy out.

    If they ring again tell them you will no longer comment on the phone and request for everything to be put into writing.;)

    How far have you got? I have gone well beyond the 8weeks normally given. I have sent them another letter telling them in no uncertain terms i will be taking court action to recover the funds if they dont reimburse me. no reply as yet....... not sure whether to just get on with it and hit them with the court action or call first? its a new area for me this


    To keep you all updated. The black horse loan of my mums includes unlawful charges and miss sold PPI. I have written to them and they refuse to refund and say they wont do anything because at the point of sale they were not FSA regulated!!!!

    I have been doing my homework and it turns out the CCJ in relation to this debt can be revoked and re looked at using a form called a "set aside judgement" because the judgemnet was incorrect. The amount they have on the CCJ is wrong because it includes PPI and charges. I will let you know what happens. It will be useful to all of you with CCJ debts thats include PPI if this set aside judgement works..........soon see

    I sent them in on 3 seperate forms, but they all relate to each other. The adjudicator says he has passed it to a colleague so they can check his assessment.

    Firstly would like to thank all contributors I used the advice on here to claim bank charges bank some time ago.

    I'm now looking to claim back my PPI which I belive was mis-sold to me.

    I sent off the standard complaint letter and recieved a reply quite quickly, unfortunatley it doesn't really resolve much but does offer me a resolution.

    Basically they have said they will refund the PPI but only off the loan not in cheque/cash form. They have offered my a quick full repayment option or a new loan minus the refunded PPI. I appreciate the response but I don't have the money for a full repayment nor am I wanting to start a restructered loan minus the refund but plus an additional APR of the same amount as when I started the original loan.

    Could I ask for some advice on this matter, it was a first and as stated final response.

    May I ask who the complaint is about?

    I understand that some work this way, where the ppi is cancelled, then a new loan is taken out without the ppi but to pay off the existing loan.
    You can then still reclaim on the mis sold PPI.
    However, if you do this make sure the rate is that equal to the original loan or better.

    If this is the final response, you are now able to complain to the Financial ombudsman service (FOS), have they confirmed this to you?

    I don't blame you, I would not want to go along with something I was not happy with either, so as you stated it was the final response, then yes I would now move on to the FOS, let them know "everything" in the complaints form.

    You can download and print one from their site or ring them to arrange to post one for you, remember to enclose copies of the correspondence with the complaints form, good luck and post anytime for further help.;)

    I used the templates 1 & 2 and sent them off to Egg. They responded saying that they did not uphold my complaint and that I could take it to the FOS. I did.
    This week the FOS adjudicator have sent me a copy of the letter they have sent to Egg requesting that they pay me my monies back. Plus interest and £200 for my stress, nearly £7,000. The letter is brilliant and includes loads of items I didn't actually complain about. It was 8 pages long! I was well impressed.
    What usually happens next? Am I likely to see the money?
    Also the adjuicator mentioned in my letter that I had PPI on my previous loans, which the final loan was a top up of and PPI was added on.
    Does this mean that they had already charged me a single premium for the previous loans and then again for the final one? If so is this something I can get the adjudicator to look into and could I be entitled to more? I and Egg have 1 week to give him any further facts.
    Can anyone help. I feel like I'm getting somewhere but not sure what will happen next.

    HI, We have received a letter from RBS stating the bank is prepared to refund the insurance premiums that we have paid to date as a gesture of goodwill. This excludes the amount automatically credited to your loan account of £425.76 when the policy was cancelled. (don't understand why this amount). Also paying back amounts we have already paid for the payment protection element of our loan. In addition to the refund, as our ppi as been cancelled, the outstanding balance of the element of your loan relating to the ppi premium will be paid off as if it never existed. (does this mean that the amount owing on the ppi will be taken off outstanding balance?) No mention of the 8%. anyone any ideas why the £425.76 amount. thanks!!!!
