    Take it to the FOS you will get a full full refund with the 8% statutory. It will take a couple of months but at least you will get back the full whack deserved. If you have no arrears you are entitled to a cheque. Dont let them fob you off

    Hi Jules

    If your stuggling with financial difficulties in arrears with anything, mortgage etc let them know, or you may have other reasons for the FOS to consider moving your case on quicker for you on fast track.
    Its just a suggestion as not everyone are aware of this, will keep my fingers crossed for both you and Ell-bee who as you know like yourself been waiting a very long time, good luck.;)XX

    Hi there

    1) I would write to ask or ring to ask if you can have this paid directly to you, no harm in trying.
    2) I would ask them about the 8% or do what Rosemahairy said, go to the FOS who automatically adds this in with your reclaim anyway, tell them you will go this direction if they do not do this for you. (its entirely your choice though), good luck.;)

    HI ALL

    Please be aware if you are querying PPI or charges on an account; whilst that account is in query (whether internal procedure or the FOS) it is against the banking code (section 13 i think) for them to take any adverse action against you or file adverse information about you whilst the account is in query.....

    Have you already had a CCJ actioned on you whilst you were waiting for an outcome on a PPI or charges query? You can apply to 'set aside the judgement' on the grounds the judgement was wrong, the amount will of course be wrong if it includes unlawful charges and miss sold PPI. Use the website http://www.hmcourts-service.gov.uk/ to guide you and download the formas you need. I am on with it now against Black horse i will keep you all updated........

    This is why I don't think they should be able to repossess you either.

    Hi Pinknico You are right they should not be able to repossess you if you have an ongoing issue with mis selling etc. but unfortunatly this is not set in stone. According to legal advice we have recieved we might still be repossessed even though we have issue with Picture. I understand it is down to the judge in question on the day. We are being repossessed by Picture home loans, formally Picture Foinancial, and although they have agreed to hold off for a futher three months it will happen and we will be repossessed all because of not been able to claim on my PPI and mis selling. It is S...T and makes me so angry. :mad:
