iva rules= you can keep 10% over your income (wages),then they take about 50% of what is left over. so i dont do any overtime at work, because of this.
i think any claims that go though, will go to the creditor to lower the balance.
there is an iva foram on this site.
i didn' relise how much help and advise i could get though 1 web site!!!:T

But mine is more a complaint about GAP insurances.0 -
i am new to this but if anyone can help me. I was recently made unemployed. I was not made redundant but dismissed (I must add that it was unfair dismissal which is going through the Employment tribunal channels). I have 2 credit cards - Capital One (£1,800) and Barclaycard (£2,900), and a loan with Black Horse (£7,900)- part of Lloyds TSB. I have been paying the insurance on all of them sinece I had them as I was under the impression they were to cover Unemployment. It's not until I come to claim that I discover that all of them are only valid for "INVOLUNTARY redundancy or if the business ceases to trade". So even if someone was made redundant, that is offered a redundancy, and they took it, that does not count. The 2 credit cards were taken out online so I'm not sure what the t's&c's on them are, but I'm sure the tick box said "Unemployment & Sickness Cover" not explaining exactly what it meant, but the loan was actually taken out in the office of Black Horse Agents and the advisor just said it was for Unemployment and Sickness cover. Can I claim against any/all of these under the fact that they were missold by not being "clear and transparent" as to what the insurance really covered and what it dosen't as to anyone, Unemploymnet apart from if someone left their job, means exactly that.0

Not sure if you have been browsing through the other threads, but its been heard that now the FOS are able to investigate ALL complaints even if that company who you taken out the finance with was not covered by either GISC or FSA at the time.
I am yet waiting for an email to come back from the FOS (Financial ombudsman service) to have this confirmed.
So say for instance you receive the final response from the letter you just sent, and they do not resolve this, still take to the FOS to have this investigated. Even if that company have said the FOS are unable to investigate.
With that letter they sent you, that is a standard fob off response, we all receive them, so you done the right thing by writing back to them.
Let us know when you hear, we can then take it from there.

Check this link here for more information and if you think it occurs to you then there is no harm in trying to reclaim, follow the reclaiming procedures with the templates, but write in your own reasons, they have 8 weeks to respond in full.

Had a response from Crap 1, stating, that when my wife took out the credit card over the phone she was given the option to listen to the PPI cover and what was covered etc, they are saying because she actually listened to the blurb, that they are not goint to refund her PPI payments, any ideas?Sparky0107 - Sealed pot challenge member #002. Can they not send the recordings to your wife?
If this was a final response, ask the FOS are they able to investigate, if its not the final response write back and ask them to reconsider, I would also request for the copy of the recordings.

They said that to me also, so I sent it to the FOS and within 8 weeks had been refunded all PPI plus interest. Dont give up. xxDS1 12/10/04
